H.B. 363 Prisoner Reimbursement for Jail Expense Dear Mrs. Bloom & Gentlemen: M~4YOR'S OFFICE MAYF~ELD YILLA(,'~ OHIO 44143 Council President Etzler has asked me to review.~Am. Sub. H.B. 363 and to prepare an Ordinance for the Village in accordance with the afore- said legislation. Attached to this Memo you will find the Mayfield Village Ordinance implementing a prisoner reimbursement plan for confinement costs. In addition to preparing the attached legislation I have also reviewed Am. Sub. H.B. 363 in order to provide you with a brief summary of its provisions. Those portions of the bill pertaining to municipal corporations are as follows: 1. Section 753.02(B) authorizes the Council to require a person convicted of an offense, other than a minor misdemeanor, and who is confined in a prison or County jail at the expense of the Village to reimburse the Village for those expenses. incurred by reason of the confinement including, but not limited to, food, clothing and shelter. The amount of that reimbursement must be determined by a Court at a hearing held specifically for that purpose. That section also authorizes the Council to direct the Law Director to commence a civil action to collect the reimbursement due if not paid. There is a one year statute of limitations for that action commencing on the date that the person is released from confinement. 2. Section 753.04(B) reads identical to Section 753.02(B) except that it pertains to costs incurred by the municipality for confinement of a prisoner in a workhouse. 3. Section 2929.15 establishes the procedure for determining the ability of a prisoner to pay pursuant to the above- referenced sections. This Section mandates that the Judge in a
