H.B. 363 <br />Prisoner Reimbursement for Jail Expense <br />Dear Mrs. Bloom & Gentlemen: <br />M~4YOR'S OFFICE <br />MAYF~ELD YILLA(,'~ <br />OHIO 44143 <br />Council President Etzler has asked me to review.~Am. Sub. H.B. 363 and <br />to prepare an Ordinance for the Village in accordance with the afore- <br />said legislation. Attached to this Memo you will find the Mayfield <br />Village Ordinance implementing a prisoner reimbursement plan for <br />confinement costs. <br />In addition to preparing the attached legislation I have also reviewed <br />Am. Sub. H.B. 363 in order to provide you with a brief summary of its <br />provisions. Those portions of the bill pertaining to municipal <br />corporations are as follows: <br />1. Section 753.02(B) authorizes the Council to require a <br />person convicted of an offense, other than a minor misdemeanor, and <br />who is confined in a prison or County jail at the expense of the <br />Village to reimburse the Village for those expenses. incurred by reason <br />of the confinement including, but not limited to, food, clothing and <br />shelter. The amount of that reimbursement must be determined by a <br />Court at a hearing held specifically for that purpose. That section <br />also authorizes the Council to direct the Law Director to commence a <br />civil action to collect the reimbursement due if not paid. There is a <br />one year statute of limitations for that action commencing on the date <br />that the person is released from confinement. <br />2. Section 753.04(B) reads identical to Section 753.02(B) <br />except that it pertains to costs incurred by the municipality for <br />confinement of a prisoner in a workhouse. <br />3. Section 2929.15 establishes the procedure for <br />determining the ability of a prisoner to pay pursuant to the above- <br />referenced sections. This Section mandates that the Judge in a <br />
