ORDINANCE N0. 83-9 <br />INTRODUCED BY: Mayor Beebe & Council as a Whole <br />AN ORDINANCE AUTHORIZING THE MAYOR <br />AND DIRECTOR OF FINANCE TO ENTER <br />INTO A CONTRACT WITH THE CITY OF <br />CLEVELAND FOR THE CONFINEMENT OF <br />PRISONERS AT THE CLEVELAND HOUSE OF <br />CORRECTIONS, AND DECLARING AN <br />EMERGENCY. <br />BE IT ORDAINED BY THE COOIQCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section lo Pursuant to the authority of Section 753.03 of <br />the Ohio Revised Code, the Ntayor and the Director of Finance are <br />hereby authorized and directed to enter into a contract with the City <br />of Cleveland for the confinement of prisoners at the Cleveland House <br />of Corrections where such prisoners have been charged and convicted of <br />any criminal act committed within the corporate limits of Mayfield <br />Village, Ohioo <br />Section 2, The contract authorized herein shall be in a <br />form approved by the Director of Law and shall be substantially <br />similar to the contract attached hereto and incorporated herein as if <br />fully rewritten. Section 3. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements, including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 4. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />health, safety and welfare of the residents of Mayfield Village, <br />Ohio, for the reason that the contract authorized herein is necessary <br />to maintain effective law enforcement. It shall therefore take effect <br />immediately upon passage by the affirmative vote of not less than five
