RESOLUTION NOe 82- 10 <br />page -2- <br />that the current use has created a condition detrimental to the <br />immediate neighborhood; and <br />WHEREAS, the investigation conducted by the municipality <br />has resulted in a determination that the current use of the property <br />by Drs. Matheis and Eadie has not extendea the use of the premises <br />beyond that which was conducted by Dr. Edwin H. Season and has <br />furthermore determined that the current use of the premises as a <br />general dental practice has not operated to the detriment of the <br />neighborhood in general; and <br />WHEREAS, the Planning and Zoning Commission of Mayfield Village, <br />Ohio, has determined that the continued use of the subject premises <br />as a general dental practice is in the best interests of the health, <br />safety and welfare of the residents of Mayfield Village; and <br />WHEREAS, the said Planning and Zoning Commission of Mayfield <br />Village, Ohio, has further determined that Drs. Matheis and Eadie <br />should be permitted to continue the operation of a general dental <br />practice from the subject premises conditioned upon the restrictions <br />hereinafter set forth; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THATe <br />Section l. Pursuant to the approval granted by the Planning <br />and Zoning Commission, the Council of Mayfield Village, Ohio, hereby <br />grants to Drs. Michael Matheis and/or Jeffrey Eadie a U-6 Permit to <br />use the premises located at 865 SOM Center Road, Mayfield Village, <br />Ohio, for the purpose of eonducting a general dental practice. <br />Section 2. This Permit shall terminate if and when Drs. <br />Matheis and/or Eadie cease to be the owners and operators of the <br />aforesaid general dental practice or for the period of four (4) <br />years from the effective date of this Resolution, whichever occurs <br />first. <br />Section 3. At such time as Drs. Matheis and/or Eadie vacate <br />the subject premises they shall provide written notice to any <br />subsequent tenant, or to the owner of the premises if different <br />from themselves, that the subject premises is zoned for single <br />family residential use and that upon their vacation of the premises, <br />the permit granted herein shall expire antl the property sha11 revert <br />to single family residential use. <br />Section 4. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution haVe been taken at open meetings of this Council; and <br />that deliberations of this Council and of its committees, resulting
