ORDINANCE N0. 82- 11 INTRODUCED BY: Council as a Whole AN ORDINANCE REQUESTING THE ISSUANCE OF BONDS OF THE STATE OF OHIO PURSUANT TO ARTICLE VIII, SECTION 13 OF TFiE OHIO CONSTITUTION AND CHAPTER 165 OF THE OHIO REVISED CODE, TO FINANCE THE ACQUISITION, CONSTRUCTION, EXPANSION AND EQUIPPING OF AN INDUSTRIAL FACILITY TO BE OWNED AND USED BY THE STANLEY WORKS WITHIN THE BOUNDARIES OF THE VILLAGE OF MAYFIELD AND DECLARING AN EMERGENCY. WHEREAS, The Stanley Works, a Connecticut corporation (the "Company") proposes to acquire, construct, expand and equip its existing facility located within the boundaries of Mayfield Village, provided that the State of Ohio makes available the financing for the acquisition, construction, expansion and equipping by the issuance of its revenue bonds pursuant to the authority of Article VIII, Section 13 of the Ohio Constitution and Chapter 165 of the Ohio Revised Code; now, therefore, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, CUYAHOGA COUNTY, THAT: Section l. That this Village, in writing, hereby requests the Ohio Development Financing Commission, acting on behalf of the State of Ohio, to issue revenue bonds of the State, pursuant to the authority of Article VIII, Section 13 of the Ohio Constitution and Chapter 165 of the Ohio Revised Code; for the purpose of financing the acquisition, construction, expansion and equipping of its existing facility (the "Project") and acknowledges that as stated in the preamble of this ordinance, it is to be located within the boundaries of this Village. It is the understanding of the Village that the Project will comply with all applicable provisions of the Planning and Zoning Code, Building Code and environmental regulations of the municipality as set forth in its Charter and Codified Ordinances. Section 2. That the Clerk of Council be and is hereby authorized and directed to forward a certified copy of this ordinance to the Ohio Development Financing Commission, which certified copy of this ordinance shall be the written request called for by division (c) of Section 165.03 of the Ohio Revised Code. Section 3. That it is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were passed in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. Section 4. That this ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety of the Village and for the further reason that this ordinance-must be immediately effective in order to permit the aforesaid
