RESOLUTION NO. 82-12 <br />INTRODUCED BY: Council as A Whole <br />A RESOLUTION AUTHORIZING MUTUAL AID POLICE <br />AND FIRE PROTECTION WITH THE MUNICIPALITIES <br />OF HIGHLAND HEIGHTS, MAYFIELD HEIGHTS, <br />LYNDHURST, RICHMOND HEIGHTS, WILLOUGHBY HILLS, <br />EASTLAKE, AND GATES MILLS, AND DECLARING <br />AN EMERGENCY. <br />SYHEREAS, pursuant to the Ohio Revised Code a municipality <br />may , in order to provide additional police and fire protection <br />in times of an emergency, pass a Resolution authorizing reciprocal <br />police and fire protection with other municipalities; and <br />WHEREAS, pursuant to the passage of a Resolution, as aforesaid, <br />the Mayor.and Finance Director are then authorized and directed to <br />execute mutual aid police and fire protection agreements with the <br />aforementioned municipalities; and <br />WHEREAS, pursuant to recent changes in the Ohio Revised Code <br />said mutual aid police and fire protection agreements need not be <br />renewed on a continuing basis as had been the practice in the past;and <br />WHEREAS, the Mayor and Council have determined that it is in <br />the best interests of the residents of Mayfield Village to execute <br />police and fire mutual aid contracts that are perpetual in nature <br />provided, however, that such contracts contain a clause allowing <br />either party to the contract to cancel upon thirty (30) days written <br />notice to the other party; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section l. The Mayor and Finance Director are hereby authorized <br />and directed to sign mutual aid police and fire protection contracts <br />in a form substantially similar to the ones attached hereto and <br />marked Exhibits "A" and "B", respectively, with the municipalities <br />of Highland Heights, Mayfield Heights, Lyndhurst, Richmond Heights, <br />Willoughby Hills, Eastlake and Gates Mills. Such contracts shall be first <br />approved by the Director of Law. <br />Section 2. All other Ordinances or Resolutions inconsistent <br />herewith are hereby repealed. <br />Section 3. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and <br />that deliberations of this Council and of its committees, resulting <br />in such formal action, took place in meeting open to the public, in
