M.V. ORDINANCE N0. 82- 28 <br />Page -3- <br />(d) It is hereby agreed that the Village sha11, at <br />its own expense, malce all rearrangements of water <br />mains, service lines, fire hydrants, valve boxes, <br />sanitary sewers or other municipally owned <br />utilities or any appurtenances .thereto which do <br />not comply with the provisions of Directive No. 28-A; <br />(e) That the construction, reconstruction or rearrange- <br />ment of both publicly and privately owned utilities, <br />refer to in subsections (c) and (d) above, shall <br />be done in such a manner as not to interfere unduly <br />with the operation of the contractor constructing <br />the improvement and all backfilling of trenches <br />made necessary by such utility rearrangements shall <br />be performed in accordance with the provisions of <br />the Ohio Department of Transportation Construction <br />and Material Specifications and shall be subject <br />to approval by the State; <br />(f) That the installation of all utility facilities <br />on the right-of-way:shall conform with the require- <br />ments of the Federal Highway Administration Policy <br />and Procedure Memorandum 30-4 "Utility Relocations <br />and Adjustments" and the Department of.Transportation's <br />Rules on Utility Accommodation; <br />(g) The Village hereby agrees that the Department of <br />Transportation of the State of Ohio shall be and is <br />hereby saved harmless from any and alI damages <br />or claims thereof arising from or growing out of <br />the certification of obligations made or agreed to <br />in Sections (a),(b),(c), (d), and (e) hereinabove. <br />Section 7. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council.and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements, including the'requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 8. This Ordinance is hereby declar.ed to be an <br />emergency measure immediately necessary for the preservation o.f the <br />health, safety and welfare of the residents of Mayfield Village, <br />in that it will expedite improvements to a main thoroughfare within <br />the municipality thereby promoting highway safety.
