ORDINANCE N0. <br />- INTRODUCED BY: <br />8 2 2 <br />`.-Council as a <br />`Whole = . -- .. - <br />AN ORDINANCE TO RESTRICT THE AUTHORITY OF <br />THE PRESIDENT OF COUNCIL, ESTABLISHING A <br />PROCEDURE TO RESOLVE DISPUTES BETWEEN THE <br />PRESIDENT OF COUNCIL AND THE MAYOR AS TO <br />DIVISION OF DUTIES AND AUTHORITY AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Charter of Mayfield`Village, Ohio, establishes <br />certain duties and authority for the President of Council and the <br />Mayor of the municipality; and . ' WHEREAS, the Codified Ordinances of Mayfield Village, Ohio, <br />attempts to further define duties and authority of the President <br />of Council and the Mayor; and. .. <br />WHEREAS, several disputes have arisen ouer the recent months <br />concerning the division of duties and authority between the President <br />of CounciT and the Mayor in those areas not explicitly covered by <br />the Charter or Codified Ordinances of Mayfield Village, Ohio; and <br />WHEREAS, the aforesaid disputes between the President of <br />CQUncil: and the Mayor have not been in the best interests of <br />efficient governmental operation for the reason that the day-to-day <br />operation of the Village is hindered where the duties and authority <br />of elected officialsis unclear and is thereby not conducide to <br />peace and harmony within the operation of the municipal government; <br />now, therefore, BE IT ORDAINED BY THE COUNCIL 0F MAYFIELD VILLAGE, OHIO, THAT: <br /> <br />Section 1. The Council of Mayfield Village, Ohio, hereby <br />determines thaF froin and after .the effective date of this Ordinance <br />any q.uestion,'uncertainty or dispute concerning the division of <br />duties and authority between the'President of Council and the Mayor <br />sha11 be decided by fihe Council as a Whole after first receiving <br />a 1egal'opinion from the Director of Law. <br />Section 2. Such decision of Council shall,be final and binding <br />on both the President of Council and the Mayor and shall be intro- <br />duced by legislation at the next regular meeting of Council. <br />Section 3. That the Council finds and determines that all <br />tormal actions of this Council relating to the adoption of this <br />Ordinance have been taken at open meetings of this Council.; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with a11 statutory requirements, including the requirements <br />of Section 121.22 of the Ohio Revised Code.
