ORDINANCE N0. 82- 44 INTRODUCED BY: Mayor & Council as a Whole AN ORDINANCE DIRECTING THAT ALL PROCEEDS FROM THE FR.ANCHISE AWARDED TO TLLERAMA, INC., DBA VIACOM CABLEVISION OF CLEVELAND, BE DEPOSTTED IN THE STREET MAINTENANCE AND REPAIR FUND OF THE MUNICIPALITY SOLELY FOR THE PURPOSES FOR WHICH SAID FUND WAS ESTABZTSHED, WHEREAS, Mayfield Village has previously enacted Ordinance 80-69, awarding a franchise to Telerama, Inc., dba Viacom Cablevision of Cleveland, for the construction, operation and maintenance of a cable communications systeni in Mayfield Village, Ohio, for a period of fifteen (15) years; and WHEREAS, Ordinance 80-69 provides, in part, that the said franchisee is to pay to the municipality, as a franchise fee, a sum equal to three percerit (3%) of the annual gross revenue of the franchi.see, with said sum to increase to five percent (5%) of the annual gross revenue if permissable by Federal Communications Commission Regulations; and WHEREAS, the Mayor and Council have determined that it is in the best interests of the municipality to require that the receipts derived from the cable television franchise, as aforesaid, be deposited in the Street Mainteriance and Repair Fund of the muni.cipality to be use.d exclusively for the purposes for which said fund is established; now, therefore, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: Section l. The Mayor and Council of Mayfield Village, Ohio, do hereby irect that all proceeds rece'ived by the municipality from the franchise awarded to Telerama, Inc., dba Viacom Cablevision of Cleveland, as provided in prdinance 80-69, be deposited exclusively in the Street Mainteriance and Repair Fund of the Village to be used sole],y for the purposes for which said Fund was established. Section 2. The Finance Director is hereby authorized and directe to deposit al1 of the proceeds from the said franchise agreement in accordance with the terms of this Ordinance. Section 3. That the Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have beeri taken at operi meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requiremerits, including the requirements of Section 121.22 of the Ohio Revised Code.
