ORDINANCE N0. 82- 44 <br />INTRODUCED BY: Mayor & Council as a Whole <br />AN ORDINANCE DIRECTING THAT ALL PROCEEDS <br />FROM THE FR.ANCHISE AWARDED TO TLLERAMA, INC., <br />DBA VIACOM CABLEVISION OF CLEVELAND, BE <br />DEPOSTTED IN THE STREET MAINTENANCE AND <br />REPAIR FUND OF THE MUNICIPALITY SOLELY FOR <br />THE PURPOSES FOR WHICH SAID FUND WAS <br />ESTABZTSHED, <br />WHEREAS, Mayfield Village has previously enacted Ordinance <br />80-69, awarding a franchise to Telerama, Inc., dba Viacom <br />Cablevision of Cleveland, for the construction, operation and <br />maintenance of a cable communications systeni in Mayfield Village, <br />Ohio, for a period of fifteen (15) years; and <br />WHEREAS, Ordinance 80-69 provides, in part, that the <br />said franchisee is to pay to the municipality, as a franchise <br />fee, a sum equal to three percerit (3%) of the annual gross <br />revenue of the franchi.see, with said sum to increase to five <br />percent (5%) of the annual gross revenue if permissable by <br />Federal Communications Commission Regulations; and <br />WHEREAS, the Mayor and Council have determined that it <br />is in the best interests of the municipality to require that the <br />receipts derived from the cable television franchise, as aforesaid, <br />be deposited in the Street Mainteriance and Repair Fund of the <br />muni.cipality to be use.d exclusively for the purposes for which <br />said fund is established; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section l. The Mayor and Council of Mayfield Village, <br />Ohio, do hereby irect that all proceeds rece'ived by the municipality <br />from the franchise awarded to Telerama, Inc., dba Viacom Cablevision <br />of Cleveland, as provided in prdinance 80-69, be deposited <br />exclusively in the Street Mainteriance and Repair Fund of the <br />Village to be used sole],y for the purposes for which said Fund <br />was established. <br />Section 2. The Finance Director is hereby authorized and <br />directe to deposit al1 of the proceeds from the said franchise <br />agreement in accordance with the terms of this Ordinance. <br />Section 3. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Ordinance have beeri taken at operi meetings of this Council; and <br />that deliberations of this Council and of its committees, resulting <br />in such formal action, took place in meetings open to the public, <br />in compliance with all statutory requiremerits, including the <br />requirements of Section 121.22 of the Ohio Revised Code.
