RESOLUTION N0. 82- 65 INTRODUCED BY: Mayor & Council as a Whole A RESOLUTION URGING THE GENERAL ASSEMBLY OF THE STATE OF OHIO TO ENACT SENATE BILL 148 WHICH WILL PERMIT THE PLEA OF "GUILTY BUT MENTALLY ILL." WHEREAS, there has been introduced in the Senate of the General Assembly of the State of Ohio Senate Bill 148 which wi11 permit the plea of "Guilty but Mentally Ill" in criminal cases which will, in part, result in a prison term of which medical care would be an integral part of the incarceration and which will further provide for the completion of a prison sentence once a guilty party has been declared mentally sound; and WHEREAS, the Mayor and Council of Mayfield Village, Ohio, hereby determine that the laws of this State should be amended so as to reflect the plea of."Guilty but Mentally I11"; now, therefore, BE IT RESOLVED BY THE COUNCZL OF MAYFIELD VILLAGE, OHIO, THAT: Section 1. The Mayor and Council of Mayfield Village, Ohio, hereby urge the General Assembly of the State of Ohio to enact S.B. 148 which will provide for the plea of "Guilty but Mentally Ill". Section 2. The Clerk of Council is hereby authorized and directe to forward a copy of this Resolution to Governor James A. Rhodes, to the entire Cuyahoga County Delegation to the General Assembly and to the Clerks of Council of the Hillcrest Area. Section 3. That the Council finds and determines that all formal actions of this Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements, including the requirements of Section 121.22 of the Ohio Revised Code. Section 4. This Resolution shall take effect at the earliest time allowed by law.
