RESOLUTION N0. 82- 65 <br />INTRODUCED BY: Mayor & Council as a Whole <br />A RESOLUTION URGING THE GENERAL ASSEMBLY <br />OF THE STATE OF OHIO TO ENACT SENATE BILL <br />148 WHICH WILL PERMIT THE PLEA OF "GUILTY <br />BUT MENTALLY ILL." <br />WHEREAS, there has been introduced in the Senate of the General <br />Assembly of the State of Ohio Senate Bill 148 which wi11 permit the <br />plea of "Guilty but Mentally Ill" in criminal cases which will, in <br />part, result in a prison term of which medical care would be an <br />integral part of the incarceration and which will further provide <br />for the completion of a prison sentence once a guilty party has <br />been declared mentally sound; and <br />WHEREAS, the Mayor and Council of Mayfield Village, Ohio, <br />hereby determine that the laws of this State should be amended so as <br />to reflect the plea of."Guilty but Mentally I11"; now, therefore, <br />BE IT RESOLVED BY THE COUNCZL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The Mayor and Council of Mayfield Village, Ohio, <br />hereby urge the General Assembly of the State of Ohio to enact S.B. 148 <br />which will provide for the plea of "Guilty but Mentally Ill". <br />Section 2. The Clerk of Council is hereby authorized and <br />directe to forward a copy of this Resolution to Governor James A. <br />Rhodes, to the entire Cuyahoga County Delegation to the General Assembly <br />and to the Clerks of Council of the Hillcrest Area. <br />Section 3. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and <br />that deliberations of this Council and of its committees, resulting <br />in such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements, including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 4.
