M.V. RESOLUTION N0.81-10 <br />Page -2- <br />departments of the municipal corporation to personal liability for <br />negligent operation of a motor vehicle under the same circumstances <br />described hereinabove; and <br />WHEREAS, the enactment of H.B. 31 would create an undefined <br />duty of care for members of the police and fire departments of a municipal <br />corporation in the operation of motor vehicles while on an emergency <br />call; and <br />WHEREAS, such undefined duty of care, by creating additional <br />liability to both the municipal corporation and to the members of the <br />police and fire-departments personally, would inhibit the members of <br />police and fire departments of a municipal corporation from fully and <br />effectively responding to an emergency call; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The Mayor and Council of Mayfield Village, Ohio <br />urge the General Assembly of the State of Ohio to defeat.proposed H.B. <br />31 for the reasons set forth hereinabove. <br />Section 2. The Clerk of Council is hereby authorized, empowered <br />and directed to forward copies of this Resolution to Governor James A. <br />Rhodes and .to all Cuyahoga County State Legislators. <br />Section 3. This Resolution shall take effect at the earliest time <br />allowed by law. <br />Alan G.
