M.V. ORDINANCE NO. <br />Page -2- <br />Council, and may be removed at any time by the Mayor, <br />subject to the approval by a vote of four (4) members <br />of Council. In case of absence or unavailability of the <br />Finance Director, the Mayor may appoint an Assistant <br />Finance Director to serve in the Finance Director's stead <br />during such absence or unavailability, subject to approval <br />by the vote of four (4) members of Council. <br />This provision shall be operative as of certification by the <br />Board of Elections of Cuyahoga. County, Ohio, and shall terminate <br />the existing term of the Finance Director, creating a vacancy subject <br />to appointment as set forth herein. <br />Section 2. Council determines that there is a real subsisting ~~ <br />emergency in the Village by reason of the non-availability of any }j <br />qualified person to serve in the .capacity of: Finance Director as <br />set forth in the current Charter provision and that continuing <br />operation of the municipality is impaired. Council therefore determines <br />that a special election is necessary for the purpose of establishing <br />the' decision of the electorate as to this proposed amendment. <br />Section`3. Council establishes June 2, 1981, as the date <br />for such special election. <br />Section 4. Council .hereby authorizes and directs the Mayor, <br />the Clerk.of Council, the Law Director, and any other applicable <br />municipal officials to take such steps as are necessary to notify <br />the Board of Elections of the passage of this Ordinance and the <br />necessity for establishing this special election and to do all things <br />necessary and proper to cause such special election to be held, <br />including the payment of any costs in connection therewith. <br />Section 'S. Due to the nature of the emergency stated herein <br />and the necessity for submitting the matter to the Board of Elections <br />at the earliest possible time to arrange such special election, this <br />is declared to be an emergency Ordinance, immediately necessary for the <br />preservation of the health, safety, and welfare of the residents of <br />Mayfield Village. It shall therefore take effect immediately upon <br />passage by the affirmative vote of not less than five (5) members <br />.elected to Council and approval by the Mayor, and shall fail, pursuant <br />to Article X of the Charter if five (5):affirmative votes are not <br />obtained. <br />PASSED: <br />APPROVED: <br />Alan G.
