M.V. ORDINANCE NO. Page -2- Council, and may be removed at any time by the Mayor, subject to the approval by a vote of four (4) members of Council. In case of absence or unavailability of the Finance Director, the Mayor may appoint an Assistant Finance Director to serve in the Finance Director's stead during such absence or unavailability, subject to approval by the vote of four (4) members of Council. This provision shall be operative as of certification by the Board of Elections of Cuyahoga. County, Ohio, and shall terminate the existing term of the Finance Director, creating a vacancy subject to appointment as set forth herein. Section 2. Council determines that there is a real subsisting ~~ emergency in the Village by reason of the non-availability of any }j qualified person to serve in the .capacity of: Finance Director as set forth in the current Charter provision and that continuing operation of the municipality is impaired. Council therefore determines that a special election is necessary for the purpose of establishing the' decision of the electorate as to this proposed amendment. Section`3. Council establishes June 2, 1981, as the date for such special election. Section 4. Council .hereby authorizes and directs the Mayor, the Clerk.of Council, the Law Director, and any other applicable municipal officials to take such steps as are necessary to notify the Board of Elections of the passage of this Ordinance and the necessity for establishing this special election and to do all things necessary and proper to cause such special election to be held, including the payment of any costs in connection therewith. Section 'S. Due to the nature of the emergency stated herein and the necessity for submitting the matter to the Board of Elections at the earliest possible time to arrange such special election, this is declared to be an emergency Ordinance, immediately necessary for the preservation of the health, safety, and welfare of the residents of Mayfield Village. It shall therefore take effect immediately upon passage by the affirmative vote of not less than five (5) members .elected to Council and approval by the Mayor, and shall fail, pursuant to Article X of the Charter if five (5):affirmative votes are not obtained.
