ORDINANCE NO. 81-45 <br />INTRODUCED BY: Mayor & Council as a Whole <br />AN ORDINANCE APPOINTING GUERIN L. AVERY AS <br />SPECIAL COUNSEL; PROVIDING FOR COMPENSATION <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, GUERIN L. AVERY has resigned as Law Director; in <br />Mayfield Village, Ohio, effective July 31, 1981; and <br />WHEREAS, Council, with the concurrence of the Mayor, has <br />expressed a desire to retain the services of GUERIN L. AVERY as <br />Special Counsel to pursue all litigation pending as of the <br />effective date of his resignation; now, therefore, <br />BE IT ORDAINED BY THE COUiVCIL OF R'lAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. GUERIN L. AVERY is hereby <br />Counsel to Mayfield Village, Ohio, to pursue all litigation pending <br />as of the effective date of his resignation, to wit: July 31, 1981. <br />appointed as Special <br />Section 2. Compensation for the services of GUERIN L. AVERY <br />shall be at the rate of Fifty-Five Dollars ($55.00) per hour, plus - <br />reimbursement for all out-of-pocket expenses, for pursuing all <br />litigation'as stated in Section 1 hereof. <br />Section 3. The contractual arrangement established herein <br />may be cancelled by either party hereto upon providing the other <br />with written notice of such intention to terminate not less than <br />thirty (30) days prior to the effective date of such termination. <br />Section 4. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of <br />the health, safety and welfare of the residents of Mayfield Village, <br />Ohio, in that it provides for continuing necessary legal representation <br />in. the pursuance of certain pending litigation. It shall therefore <br />take effect immediately upon passage by the affirmative vote of <br />not less than five (5) members elected to Council and approval by <br />the A4ayor or otherwise at the earliest time allowed by law. _ <br />Lawrence J.
