M.V. RESOLUTION NO. 81- 63 <br />Page -2- <br />5. Any debris or waste accumulated on the <br />property as a result of the sale of Christmas trees <br />authorized herein shall be removed by the parties <br />mentioned hereinabove on or before December 28, 1981. <br />The David R. Wiley Memorial Park shall be left by the <br />said parties in substantially the same condition as it <br />is on the day the trees are delivered. Any damages to <br />said park shall be the sole responsibility of the parties <br />mentioned herein. <br />6. The said parties agree to indemnify and hold <br />harmless the municipality from any and all claims, demands, <br />or loss arising from or in any way connected with the sale <br />of the Christmas trees authorized herein, whether such <br />claims are made by the said parties or by any third parties. <br />7. The said parties shall acknowledge their <br />acceptance of the terms and conditions set forth hereinabove <br />by signing the certified copy of this Resolution in the <br />presence of the Mayor and the Director of Law. <br />Section 2. The Finance Director is hereby authorized and <br />directed to deposit all moneys derived from the sale of Christmas <br />trees authorized herein in the Community Room Fund. <br />Section 3. Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Resolution <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements, including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 4. This Resolution is hereby declared to be an <br />emergency measure immediately necessary for the preservation of <br />the health, safety and welfare of the residents of Mayfield Village, <br />Ohio, in that the moneys derived from the sale authorized herein is <br />to inure solely to the benefit of the construction of a community <br />room and the parties authorized. herein to conduct such sales must <br />immediately make all preparations necessary in order to conduct <br />said sales. It shall therefore take effect immediately upon the <br />passage by the affirmative vote of not less than five (5) members <br />elected to Council and approval by the Mayor or otherwise at the <br />
