a <br />ORDINANCE NO. 80- 22 <br />INTRODUCED BY: Council as a Whole <br />AN EMERGENCY ORDINANCE:AUTHORIZING THE ACCEPTANCE <br />OF AN EASEMENT FROM ADELINE KRENZLER, TRUSTEE, <br />HENRY' J. SCHMIDT AND THE HAYFIELD VILLAGE RACQUET <br />CLUB, I'NC. FOR THE USE, MAINTENANCE, REPAIR AND <br />REPLACEMENT OF A SANITARY SEWER LINE. <br />WHEREAS, this Council has previously authorized the con- <br />struction of a Municipal Service Building within the Village; and <br />WHEREAS, in connection with the construction of said <br />Service Building it was necessary to install a sanitary sewer line <br />and manhole on and under a portion of the land owned by Adeline <br />Krenzler, Trustee, and leased to Henry J. Schmidt and the Mayfield <br />Village Racquet Club, Inc.; and <br />WHEREAS, Mayfield Village has requested from Adeline <br />Krenzler, Trustee, Henry J. Schmidt and the Mayfield Village Racquet <br />Club, Inc., an easement in, underneath and through the land owned by <br />and leased to the above-stated parties for the purpose of using, <br />maintaining, repairing and replacing the said sanitary sewer line; <br />and <br />WHEREAS, Mayfield Village has granted to Adeline Krenzler, <br />Trustee, Henry J. Schmidt and the Mayfield Village Racquet Club, Inc., <br />an easement in, underneath and through a portion of its land for the <br />purpose of using a certain channeled stream for the transportation <br />of storm water and surface drainage; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The Mayor and Finance Director are hereby <br />authorized, empowered and directed to execute the Sanitary Sewer <br />Easement which is attached hereto and incorporated herein as if fully <br />rewritten, the same granting to Mayfield Village an easement in, under- <br />neath and through a portion of the land owned by Adeline Krenzler, <br />Trustee, and leased to Henry J. Schmidt and the Mayfield Village <br />Racquet Club, Inc., for the purpose of using, maintaining, repairing <br />and replacing a certain sanitary sewer line, all of which is more <br />fully described in the attached document. <br />Section 2. This ordinance is declared to be an emergency <br />measure immediately necessary for the preservation of the peace, <br />health, safety and welfare of the residents of Mayfield Village in <br />that it will provide means to assure the continued optimum use of <br />
