ORDINANCE NO. 80- <br />Page -5- <br />(k) Any device designed to emit an alarm upon detection <br />of smoke, fire or unauthorized intrusion shall constitute <br />a nuisance if ten (10) or more false alarms are emitted and <br />reported to the Police or Fire Departments; or both, in any <br />twelve (12) month period. In that event, the Law Director <br />shall take appropriate civil or criminal action to abate <br />such nuisance. <br />971.08 LIABILITY OF HAYFIELD VILLAGE: The issuance of <br />any permit in conjunction with this Chapter shall not <br />constitute acceptance by the Village of any liability to maintain <br />any equipment, to answer alarms or for anything in connection <br />therewith. <br />971.09 RULES AND REGULATIONS: The Mayor, or his <br />designated representative, shall make and enforce such rules <br />and regulations as he may deem necessary for the enforcement <br />of the provisions hereof and for the proper determination <br />and collection of the fines, fees and charges herein provided. <br />971.10 PERMIT REQUIRED; FEE: A permit from the Building <br />Department. shall be required before the installation of any <br />alarm covered by Section 971.03. Each permit application <br />shall be accompanied by a fee of Ten Dollars ($10.00). For <br />purposes of this Section, a permit application for the <br />installation of an alarm system connected to both the Police <br />Department and Fire Department shall require only one permit <br />fee if both alarms are to be installed at the same time <br />thereby requiring only one inspection under Section 971.03(c). <br />Section 2. Violation of any provision of this.Ordinance <br />shall constitute a misdemeanor of the fourth degree and shall be <br />fined accordingly except for a specific fine as set forth herein. <br />Section 3. Ordinances 79-81 and 80-23 are hereby repealed. <br />Section 4. This Ordinance is declared to be an emergency <br />measure immediately necessary for the preservation of the health, <br />safety and welfare of the residents ,of Mayfield Village in that it <br />will correct abuses currently existing with regard to alarms and <br />alarm systems which detract from the efficiency of the Police and <br />Fire Departments. It shall therefore take effect immediately upon <br />passage by the affirmative vote of riot less than five (5) members <br />
