CONSTRUCTION SCHEDULE <br />(a) Upon accepting the franchise, Grantee shall, within <br />thirty (30) days, file the documents required to obtain all <br />necessary federal, state and local licenses, permits and <br />authorizations required for the conduct of its business, and <br />shall upon request of the Village submit reports to the Village <br />Council on progress in this respect until all documents are <br />in hand. <br />(b) Within ninety (90) days after acceptance of the <br />franchise the Grantee shall submit to the appropriate electric <br />power and telephone utilities, in the form and with the bonds <br />or cost deposit required by such utility companies, applications <br />for attachment of Grantee's cable and related equipment to <br />all utility poles necessary for construction of the Cable <br />Communications System and provision of Cable Television Service as <br />required in Section 4 of this Ordinance. <br />(c) Attachment of strands preliminary to stringing of <br />cable between utility poles shall commence within ninety (90) <br />days after the utility companies give "pole releases" or <br />permission for such attachment and construction activity shall <br />thereafter be continuous and with due diligence. At the request <br />of Grantee, the Village Council may extend such time limitation <br />for good cause shown. <br />(d) Construction and installation of the system shall <br />be completed, as presented in Grantee's application, within <br />eighteen months of the date on which permission for attachment <br />is received by the Grantee. If such permission is granted in <br />stages the time limit shall run from the date on which permission <br />for the final stage is received. <br />SECTION 12. FRANCHISE FEES <br />(a) The Grantee herein shall pay to the Village for <br />the use of the streets and other facilities of the Village <br />in the operation of the cable television system and for the <br />municipal supervision thereof during the life of the franchise <br />a sum equal to three percent (30) of the annual gross revenue <br />of the Grantee. Grantee shall pay to Village a franchise <br />fee of five percent (50) of the annual gross revenue if <br />permissible under FCC regulation. Grantee shall cooperate with <br />Village in seeking any waivers necessary for fees in excess of <br />three percent (30). It is understood that franchise fees in <br />excess of three percent (30) may be added to consumers' periodic <br />billings.
