<br />repair and remove mains and pipes, with the aeceasary feeders~ene~.
<br />'service pipes, drips at~d other dev3Qes~comreaient to the operation
<br />of such mains and pipes, in, through, under and from the streetss
<br />alleys, public mounds and public places~.of the Village of Mayfield,
<br />Ohio, for the supply of natural ~ga$ to the said Village of Mayfield
<br />and -its inhabitants, and the transportation thereof through, the said
<br />Village of ~yPield.
<br />BE IT ORDAINED BY TIC y COi~tCII, OF TBE VILLAGE OF HAYFIELD, STATE OF OI~Oa --
<br />Sect~.on 1. Subject to the terms cad conditions of this ordinaaoe
<br />there is hereby granted to Th®.East Oh~.o Gas Company, its suoc®ssors-and_
<br />as$igns.. ( hereinai'ter called the "Compat~}r", atld Wh®naver so used shall be
<br />deemed to mean The East Ohio Gas Coaupany,_its suds®ssors and assigns), the
<br />right to lay, extend, maintain, operat®, relocate, repair egad remove,mains and
<br />pipes, in, through, under and-from the streets, alleys, public grounds artd
<br />public places of the said Village of Hayfield, ahio~ (hereinafter ~~lled the
<br />"Vi11ag®", and. wherever so used shall be dee~ued to wean the Village of
<br />Mayfield, Ohio) for the transportation and supply of natural gas to the
<br />Village attd its inhabitants, and the transportation thereof is end through
<br />-, the Village. .

<br />Section 2. In the work~of laying, extending, maintaining, operating,
<br />-~ re-loaating,.repairing. and re~nov3.ng of.its`mains and. pipes cad other structures
<br />in the_Village, the Company shall. not unnecessarily obstruct nor itrterfere
<br />with the ordinary use -or opoupation of ax~r street, all®y, public ground or
<br />public plane, nor inure nor 'interfere with, nor change any existing arrange-
<br />, meat such as sewers or -water mains already laid or hereafter to be laid in
<br />the V3.Ilage. The location and mamner of laying sa3.d itairts end pipes in the
<br />streets, alleys, public grounds and public places, in the Village shall b® _
<br />under the direction ar~d subject to the approval of the municipal officer
<br />having charge of said streets, alleys, public grounds and public places.
<br />Section 3. All mains and pipes-shall be laid with reference to the
<br />present surface grade of the streets, allays, public grounds and. public
<br />planes through which the~same may be planed; end in ease the grade of such
<br />street, alley or public grounds shall hereai"ter be changed by the Village,
<br />the Compat~y eha31 cause its mains a~el pipes to be relaid in conformity to
<br />such changed grade at its own expense and aheill not be eartitled to say
<br />compensation or damage from the Village by reason of such change of grad®.
<br />Section 4 1~henever the Coanpaz{y shall ppen ground in aay~ street,
<br />alley, public ground or public place of the Vi11ag®, it shall, after laying
<br />sunh mains cad pipes or doing other necessary work, restore the pavement
<br />sidewalk and ground to a condition equally as good as before, and shall not
<br />permit azay street, alley, public ground or public plane to remain open for a
<br />longer period-than. may be reaeaaably necessary to execute the work for which
<br />~``" - the same. shall. have .been opened. If the Company fails to do away of the work
<br />`';~:~' required by this section, the same.may be,done by the Village and the Company
<br />shall be liable for the Host thereof.
