<br />AN ORDINANCE TO PROHIBIT GAMBLING IN THE VILLAGE OF
<br />MAYFZELD. ..
<br />BE IT ORDAII~D BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, CUYAH~A
<br />COUI~ITY, -QHIO, . THA~.a _ . - . _ --
<br />Secg 1, It shall be uawful for any person, firm,. corporation,
<br />organization, society 6~ a~~esatibt-9 or atay officer, employee, agent,
<br />serva2at, member or representative therecf, unless licensed as prescribed
<br />in Section of this Ordinances to vend, sell, barter or dispose of a
<br />ticket, order, or device, for or representing a number of shares or an
<br />interest in a lottery~or scheme of chance, by ~rrhatever name, style ar
<br />title, detzarnir,ated or known, whether located or to be drawn, paid or
<br />carried on within or without the Village of Hayfield or State of Ohio;
<br />to establish, open, carry on, promote, make, draw or act as a backer or
<br />veandor for or on account of a lottery or scheme of chance, by whatever
<br />narie, style or title denominated or kno~,tn, whether located or to be
<br />drawn, paid, or carried on,w~:t .or without the Village of Mayfield
<br />or State of Ohio; or to establish, open, caxry on, }~rc;anotes make, drav~r
<br />or act as a vendor or backer for or on account of a scheme of chance
<br />known as "policy", "numbers game", °clvaring house", or by wox°ds or
<br />terms of similax~isport, ~rhether_located or to be drawn, paid or
<br />carried on within or without the Village of Mayfield or State of Ohio,
<br />or by any of such means~to sell or offer anything for salad The acts
<br />or things described in this section are sometimes hereinafter.refer-red
<br />to in this ordinance as "games of chance"v
<br />Sea. 2~ Whoever violates at~T of the provisions of this
<br />ordinance shall be guilty of a m3.sdemeataor, and upon conviction thereof
<br />shall be fined not Less than X50..00 nor more theta ~1s000.00, or
<br />imprisoned for not more than 30 days, or both, and shall stated eonva.cted
<br />until such penalty is paid, and each daygs violation shall constitute
<br />a separate offense, _
<br />Secs 3. Not~rrithstanding the provisions of Sections 1 and 2
<br />of this ordinance, a, game of chance, other than policy, numbers game
<br />or clearing house, may be carried on by era organization, society or
<br />association within the Village of Mayfield, only if (1) the entire
<br />gross proceeds from such game of chance (over and above the cost of
<br />printing tickets and the amounts paid in.ca.sh or property to the
<br />participants as prizes) are expended for one or riore chartable,benevolent,
<br />philanthropic or religious purpose, and (2) the Mayor shall have, prior
<br />to the holding of such game of chance and- prior to the performance of
<br />atatiy acts in the promotion of the same, determined that the entire gross
