ORDINANCE No. 378 By Mr. Taylor AN ORDINANCE DETERMINING TO PROCEED Vi17TH THE IMPROVEMENT OF WILSON 114ILLS ROAD FROM THE WESTERLY. CORPORATIODT LINE. OF THE VILLAGE OF HAYFIELD, OHIO,-IN_AN EASTERLY DIRECTION TO THE WESTERLY LINE OF ECHO DRIVE. BY THC CONSTRUCTIOTd. OF A V`1ATER MAIN®. WHEREAS, this Council. adopted Resolution No. 181 on January 29, 1951, declaring the necessity for improving V4`ilson Mills Road from the westerly corporation line of the Village of Mayfield, Ohio, in an Easterly direction to the westerly lino of Echo Drive by the construction of a water main in accordance with the plans, specifications, estimate of cost and profiles prepared by the Village Engineer and on file in the office of the Clerk of the Village of Mayfield, and 'NHEREAS, a oertificate of the Clerk of Council has been filed showring service of notice of the passage of such resolution on the owner of each lot and parcel of property on said u~lilson Mills Road between the westerly corporation line of the Village of Mayfield and the westerly line of Echo Drive by personal service and publicatiotz, and WHEREAS, the Clerk of Council has certified that no claims for damages have been received during the claim 'period, and' V~tHEREAS, emergency resolutio~a No. ].84, adopted June 18, 1951, _ authorized the Mayor and. Clerk of the Village of Highland Heights, Ohio, to enter into a contract vui.th the Mayor acid Clerk of the Village of Mayfield, Cuyahoga County, Ohio, concerning the construction of a water main iix Wilson Mills Road from Lander Road easterly 4,054.5 feet to the corporate line of Higln.loxad Heights Village, which is the distance of the common boundary of the Village of Highland Heights, Ohio, and the Village of hayfield, Ohio, .and ~ . VUHERF..AS, the Council desires to proceed v~.th the said improvement: BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, STATE OF OHIO, THREE-FOURTHS OF ALL ME~iJlBERS ELECTED THERETO.. CONCURRING: Sec. le That it is hereby determined to proceed with the improve meat of Wilson Mills Road from the westerly corporation line of the Village of Mayfield in an easterly direction to the westerly line of Echo Drive, by the constx~.~ction of a water mama, all in accordance vai.th Resolution No. 181, adopted January 29, 1951$ and in accordance vrith the general plalas, specifications, estimates and profiles heretofore approved and now on file in the office of the Clerk of P•gayfield Village. Sec. 2® That all claims for damages resulting therefrom shall be judicially itaquirr~d into after the completion of the proposed improvement and the sola.citor be and he is hereby authorized and directed to institute proceedings in a court of competent jurisdiction to inquire into alaims.
