• <br />Sec. 3® That the whole cost of the improvement, less 13.35~a. <br />thereof, shall be assessed in proportion to the benefits which may result <br />from the improvement upon the z"ollowing described lots and Iands, to merit: <br />all the lots and lands bounding and abutting upon the northerly and southerly <br />side of Wilson Dills Road from the v~resterly corporation line of Mayfield <br />Village to the westerly line of Echo Drive in the Va.llage of Mayfield, Ohio, <br />wra.ch said lots and lands are hereby determined to be specially benefited by <br />said improvement; that the cost of said improvement shall include the expense <br />of the preliminary and other surveys,, and of printing and publishing the <br />notices, resolutions and ordinances required, and the serving of said notice, <br />and the cost of construction together with interest on notes and bonds <br />issued in anticipation of the collection of deferred assessments, and all <br />other necessary expenditures. <br />Sec. d--. That the assessments so to be levied shall be paid in ten (ZO) <br />annual installments, with interest on deferred payments, at the same rate as <br />shall be borne by the bonds so to be issued in anticipation of the cols coons <br />thereof; provided that the rnnTner of any property assessed may, at his option, <br />pay such assessment in cash within thirty days (30) from and after the passage <br />and legal publication of the assessing ordinance. <br />• Soe. 5. That bonds of the Village of Mayfield shall be issued in <br />anti cip ation of the collection of assessments by installments and in an amount <br />equel thereto and notes of said Village of Mayfield shall be issued in anticipation <br />of the levying of such assessments and the issuance of bonds. <br />Sec. G. That the remainder of the cost of said improvement shall be <br />paid by the issuance of bonds in the manner provided by law and notes of said <br />Village of Mayfield shall be issued in anti cipation of the issuance of such bonds. <br />Sec. 7. That the Clerk and Mayor be, and they are, hereby authorized <br />and directed, as soon as the funds therefore are available, to make and execute <br />a contract for said improvement vrith the lowest and best bidder, after adver- <br />tisement according to law. <br />Sec. 8. That this ordinance shall take effect as an emergency <br />measure for the reason that funds are required x'or the immediate construction <br />of said improvement for the convenience, necessity and welfare of the citizens <br />of Mayfield Village and shall take effect and be in full force from and after <br />its passage as an emergency measure, otherwise it shall take effect a.t the <br />earliest time allowed by law. <br />Passed 1951e <br />Attests <br />7 <br />Clerk <br />Mayor <br />~~~- <br />
