Sec. 3. That the whole cost of the improvement, less 18.0/ thereof, <br />shall be assessed in proportion to the benefits which may result from the <br />improvement upon the follovring described lots and lands, to tvit: all the lots <br />and lauds bounding and abutting upon the easterly and westerly side of S.O.I~lI. <br />Center Road from the center line of 1Prilson ~!ri11s Road northerly to the <br />north line of the property of the. Board of Education, in the Village of <br />Mayfield, Ohio, which said lots and lands are hereby determined to be <br />specially benefitted by said improvement; that the cost of said. improve- <br />ment shall include the expense of the preliminary and other sur~~neys, and of <br />printing and publishing the notices, resolutions and ordinances required, <br />and the serving of said notice, and the cost of construction together With <br />interest on notes atld bonds issued in anticipation of the tolls ction of <br />deferred. assessments, and all other necessary expenditures. <br />Sec. 4. That the assessments so to be levied shall be peid in ten <br />(10~ annual installments, with interest on deferred payments, at the same <br />rate as shall be borne by the bonds to be issued in anticipation of the <br />collections thereof; provided that the oUrner of any property assessed may, <br />at his option, pay such assessment in cash within thirty days (30) from <br />and after the passage and legal publication of the assessing ordinance. <br />See. 5. That bonds of the Village of Mayfield shall be issued in <br />anticipation of the collection of assessments by installments and in an amount <br />equal thereto and notes of said Village of Mayfield shall be issued in <br />anticipation of the levying of such assessments and the issuance of bonds. <br />Sec. 6. That the remainder of the cost of said improvement shall be <br />paid by the issuance of bonds in the manner provided by latiu and notes of <br />said Village of Mayfield shall be issued in anticipation of the issuance <br />of such bonds. <br />Sec. 7. That the Clerk and Mayor be and they are hereby authorized <br />and directed, as soon as the funds therefore are available, to make and <br />execute a contract for said improvement with the lowest and best bidder, <br />after advertisement according to law. <br />Sec® 8. That this ordinance shall take effect as an emergency <br />measure for the reason that funds are required for the immediate construction <br />of said improvement for the convenience, necessity and welfare of the citizens <br />of Mayfield Village and shall take effect and be in full force from and <br />after its passage as an emergency measure, otherwise it shall take effect <br />at the earliest time allowed by la:~~vo <br />Passed , 19514 <br />P!iayor <br />Attest: <br />Clerk <br />
