ORDINANCE No. 411 <br />By Mr. Endress <br />AN ORDINANCE TO PAY THE CLAIM OF JOHN DF HAAN <br />V~iEREAS, on the 31st day of March, 1952, at about 12:15 P. M.' <br />John De Haan, a volunteer fireman, was in the course of his duties <br />proceeding in his own automobile, fgllowing the Village Fti.re Truck , <br />in answering a call to put out a fire at the residence of J. Post on <br />SOM Center Road, and, while both 'vehicles were stopped, the driver of <br />the Village F`i.re Truck without warning or signal backed the same into <br />the automobile of John De Haan, causing damage thereto in the amount of <br />$p122.37, and John De Haan has made claim against the Village in said <br />amount; and . <br />WI~REAS, the liability insurance on the fire truck does not <br />cover this-accident because the fire truck was being used in an emergency <br />on the way to a fire and the Village is not lega]ly liable; and <br />VYHEREAS, it is nevertheless the desire of Council to compensate <br />John D® Haan for the damage caused to his automobile through no fault <br />Qf his own and while acting as a volunteer for the public welfare. <br />NOZ~'THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF <br />HAYFIELD, _ CUYAHOGA _ COiJNTY, OHIO, THAT e . <br />Sec. 1. The Clerk is hereby authorized to issue a check to <br />John De Haan in the amount of $p122.31 to compensate. him for the damage <br />caused to his automobile on the 31st day of March, 1951, by reason of the <br />action of the driver of the Village fire truck in backing the same into <br />the-automobile•of John De Haan. <br />Sec. 2.
