ORDINANCE No. x.26 <br />By Dr. Waltz <br />AN ORDINANCE ALTTHORI7iINCr THE PLdLNNNG COMI+~SSION TO <br />RESERVE AREAS FOR PUBI,TC USE AND PROHTSITING THE <br />IMl'ROVEIvYENT OF SUCH AREAS FOR A PERIOD OF 90 DAYS <br />AFTER APPLICATION THEREFORs <br />BE IT ORDAINED 3Y THE COUNCIL OF THE VILLAGE OF HAYFIELD, STATE OF OHIO: <br />Sec. 1. That the Planning Commission be, and it is hereby, authorized, <br />upon the preparation of a plan and map of the vrhole or any portion of <br />municipality which shall show the Commi.ssionts recoannendation for the general <br />location, character and extent of streets, alleys, ways, bridges, boulevards, <br />parkways, parks, playgrounds and other public grounds, ways and open spaces, <br />the general location of public buildings and other public property, to <br />designate by a good and sufficient legal description within the area so <br />planned and mapped, the areas deemed by it necessary for_the municipality <br />to acquire in order to effectuate the purposes of the plan and map; such <br />designation, however, need not be of the whole of the area generally proposed <br />for public use, but may be done by a series of resolutions passed from time <br />to time, each describing part only of the v~nole area determined necessary <br />for the municipality to acquire. <br />Sec. 2. Upon the passage of a resolution designating certain areas <br />as necessary for the municipality to acquire in order to effectuate the plan <br />and map' the Planning Commission shall causeya copy of said resolution, duly <br />certified, to be delivered to the Building I spector of the municipality <br />and the Council, r <br />Sec. 3. From and after the date of the receipt of such certified <br />resolution,~he Building Inspector shall not issue a permit for the improvement <br />of the land so described, or adjacent thereto, inconsistent with the terms <br />and provisions of said resolution for a period of ninety (90} days from and <br />after the date that an appl~.cation for the improvement is filed with the <br />Building Inspector. <br />Sec. !~. Upon the filing of an application for the improvement of the <br />land so descrl'~ed, or adjacent thereto, inconsistent with the terms and <br />provisions of said resolution, the Building Inspector shall forth~rith notify <br />the Council and the Planning Commission in writing of the filing of such <br />application. <br />Sec. 5. Unless the land so described is acquired by the municipality, <br />or an action for the appropriation thereof instituted in accordance with law, <br />within said ninety-day period, the application for the improvement as filed <br />with the Building Inspector, provl.ding the same is in all other respects in <br />accordance with law, shall be issued. <br />Sec. 6.
