constructing a water main, all in accordance with Resolution No. 21?, <br />adopted April 20th, 1953, and in accordance with the plans, specifications, <br />estimates and profiles heretofore approved and now on file in the office <br />of the Clerlc of said Village. <br />Sec. 2. That all claims for damages resulting therefrom shall be <br />judicially enquired into after the completion of the proposed improvement <br />and the Solicitor be, and he is, hereby authorized to institute proceedings <br />in a court of competent jurisdiction to enquire into claims. <br />Sec. 3. That Eighty eight percent (88%) of the cost of said <br />improvemen~sh ll.be assessed in proportion. to .the benefits which may result <br />from the improvement upon the following described lots and lands, to zvit: <br />All the lots and lands bounding and abutting upon the Easterly and Westerly <br />sides of S.O.M. Center Road, starting at the North end of the existing <br />water main now located in S.0'.M. Center Road and extending Northerly about <br />1801 feet, but to the South line of a 22 acre parcel of land now or formerly <br />owned by Jessie H. Worts, being approximately 2257 feet North from the <br />center line of Wilson Mills Road, in the Village of Mayfield, Ohio, which <br />said lots and lands are hereby determined to be especially benefited by <br />said improvement; that the cost of said improvement shall include the <br />expense of the preliminary and other surveys, and of printing and publishing <br />the notices, resolutions and ordinances required, and the serving of said <br />notices, and the cost of construction, together with interest on notes <br />and bonds issued in anticipation of the collection of deferred assessments, <br />-~~ and all other necessary expenditures. <br />~- Sec. ~e That the assessments so to b e levied shall be paid in <br />ten (7.0) ann~installments, with interest on deferred payments, at the <br />same rate as shall be borne by the bonds to be issued in anticipation of <br />the collections thereof; provided,that the rnmer of any property assessed <br />may, at his option, pay such assessment in cash within thirty (30) days <br />from and after 'the passage and .legal, puoli_cation of the assessing-ox~ii.nances. <br />Sec, 5'. That bonds of the.Village of Hayfield shall be issued in <br />anticipation of the collection of assessments by installments and in an <br />amount equal thereto, and notes of said Village of Hayfield shall be issued <br />in anticipation of the levy of such assessments and the issuance of bonds. <br />Sec. 6. That the remainder of the entire cost of said improvement, <br />12~,not -.:spec~`ly assessed, shall be paid by the Village of Mayfield by the <br />issuance of bonds in the manner provided by law and notes of said Village <br />of ~Jtayfi.eld shall be issued in anticipation of the issuance of such bonds. <br />Sec. 7. That the Clerk and Mayor of the Village of Mayfield be, <br />and they eF~i r y are, authorized and directed, as soon as funds therefore are <br />available, to make and execute a contract for said improvement with the <br />lowest and best bidder, after advertisement according to law. <br />Sec, 8.
