Sec. 1. That it is hereby determined to proceed with the improvement <br />of Wor own ParT~ Drive in the Village of Mayfield, Ohio, from Wilson Mills Road <br />to the end of the dedicated street, which is 1315.60 feet from the South line <br />of Wilson Mills Road, by establishing the grade and constructing a water main, <br />all in accordance with Resolution No. 219, adopted June 15, 1953, in accordance <br />with the Petition of property oti~uners described in said resolution and herein= <br />above described, and in accordance with the plans, specifications, estimates <br />and profiles heretofore approved and now on file in the office of the Clerk <br />of said Village. <br />Sec. 2. That all claims for damages resulting therefrom shall be <br />juclicia~ly enquired into after the completion of the proposed improvement <br />and the Solicitor be, and he is, hereby authorized to institute proceedings <br />in a, court of competent jurisdiction to enquire into claims. <br />Sec. 3. That the entire cost of said improvement shall be assessed in <br />proportion to the benefits which may result from the improvement upon the <br />following described lots and lands, to--wit: All the lots and lands bounding <br />and abutting upon both sides of Worton Park Irrive ire the Village of Mayfield, <br />Ohio, from Wilson ~.lls Road to the end o_f the dedicated street, which is 1315.60. <br />feet from tYie South -line of Wilson Mi11s Road, which said lots and lands are <br />hereby determined to be specially benefited by said improvement; that the <br />cost of said improvement shall include the expense of the preliminary and other <br />surveys, and of printing and publishing the notices, resolutions and ordinances <br />required, and the serving of said notices, and the cost of construction, together <br />with interest on notes and bonds issued in anticipation of the collection of <br />deferred assessments, and all other necessary expenditures. <br />Sec. I~. That the assessments so to be levied shall be paid in ten (10) <br />annual ins a tints, with interest on deferred payments, at the same rate. <br />as shall. be borne by the bonds to be issued in anticipation of the collections <br />thereof; Ir ovided, that the owner of any property assessed may, at his option, <br />pay such assessment in cash within thirty (30) days from and after the passage <br />and legal publication of the assessing ordinances. <br />Sec. 5. That bonds of the Village of Mayfield shall b e issued in~ <br />anticip~ion of the collection of assessments by installments and in an amount <br />equal thereto, and notes of said Village of Mayfield shall be issued in <br />anticipation of the levy of such assessments and the issuance of bonds, <br />Sec. 6. That the Clerk and Mayor of the Village of Mayfield be, and they <br />hereby are, authorized and directed, as soon as funds therefore are available, <br />to make and execute a contract for said improvement with the lowest and best <br />bidder, ai?ter advertisement according to law© <br />See. 7.
