Sec. 1. That it is hereby determined to proceed with the improvement <br />of Bonnieview~~oad in the Village- of Mayfield, Ohio, from SOM Center Road <br />in ari Easterly Direction to the Westerly line of Beach Hill Road, by establishing <br />the- grade and constructing ~a water main' all in accordance- with Resolution No. <br />223, adopted July 21, 1953, in accordance with the-Petition of property-owners <br />described ixi said resolution and herenabove described, and in accordance <br />with the plans, specifications, estimates and profiles heretofore approved <br />and now on file in the-office of the Clerk of said Village. <br />Sec. 2e That all claims for damages resulting therefrom sha71 ~be <br />judicial enquired into after the completion of the proposed improvement <br />and the Solicitor be, and he is, hereby authorized to institute proceedings <br />in a court of competent jurisdiction to enquire into claims. <br />Sec. 3. That the entire cost of said improvement shall be assessed <br />ixi propo i:on to -the- benefits which may result from the improvement upon <br />the followi.aag described lots and lands, to-wit: All the lots and lands <br />bounding and abutting upon both sides of Bonnieview Road in the Village of <br />Mayfield, Ohio, from SOM Center Road in an Easterly direction to the <br />Westerly line of Beach Hill Road, which said lots and lands-a-re hereby <br />determined to be specially benefitted by said improvement; provided, however, <br />that the parcel of property on the Northeast corner of Bonnievi.ew Road and <br />SOM Center Road owned by H. W. Corlett, being Auditor°s_Permanent Parcel <br />No. 831 38-7 sha].1 be exempted its- full 207 feet- from: the assessment for <br />the cost of improving-Bonnieview Road, and that the property on the <br />Southeast corner of Bormieview Road and SOM Center Road owned by Wi7.liam <br />and Marion Noose, being Auditor°s Permanent Parcel No. 831-38-6, shall be <br />exempted its full 207 feet frontage from the assessment for the cost of <br />improving Bonnievieti~ Road; that the cost of said improvement shall include <br />the expense- of. the pre-li:minary and other surveys, and of printing and <br />publishing the notices, resolutions and ordinances required, and the <br />serving of said notices, and the cost of construction, together with <br />interest on notes and bonds issued in anticipation of the collection of <br />deferred assessments' anal all other necessary expenditures. <br />Sec. !t. That the Assessments so to be levied shall be-paid in ten <br />(10) annual installments, with interest on deferred payments, at the same rate <br />as shall be borne by the bonds to be issued in anticipation of the co]~.ections <br />thereof; provided, that the owner of any property assessed may,° at his option <br />pay such assessment i.n cash within thirty (30 days from and after the passage <br />and legal publication of the assessing ordinances. <br />Sec® 5. The bonds of the⢠Village of Mayfield sha11 be issued in <br />anti.cipa ion n o~ the collection of assessments by installments and in an aanount <br />equal thereto, and notes of said Village of Mayfield shall be issued ira <br />anticipation of the levy of such assessments and the issuance of bonds. <br />.Sec. 6, That the Clerk and Mayor of the Village of ~+~ayfield be, and <br />they hereby are, authorized and directed, as soon as funds therefore are <br />available, to make and execute a contract for said improvement with the <br />lowest and best bidder, after advertisement according to law. <br />
