AN ORDIPJAlUCE AUT 1FDRIZ ING THE SALF AND (JOTdVEYAIdCE OF THE ELECTRIC DISTRIt3tiTI0N PLANT OF THE VILLAGE OF 2:UYF'IELll TO THE CLFVEL3IUD ELLCIRIC ILLUMINATIP1G COPIt'tiNY. 71HEREAS, on the 25-uh daf of June.; 1923, the Council of the Vi7.lage passed Ordizance No. 39, entitled "Ordinance of the Village of It4ayfields Cuyahoga County' Ohio, relating to the construction and operation of a plant for furnishing electricity to the Village and its inhabitants", and I"EIEREA.S, on the 28th day of SeptemUer, 1923, the Village leased to The Cleveland Electric Illuminating Company its e7.actric distribution plant constructed pursuant to the said ordinance, and ? iN?iEREAS, The Clevela.nd Electric Illuminating Company in letter dated November 7th, 1925, has notiiied the Village of its intention to exercise the option to purchase the said plant, as provided for in said lease, and has oifered to pay to the Village for the plant as of the lst day of No vember, 1925, the sum of Ten Thousand Four Kiandred Sixty-seven and 49/100 dollars ($10,467.49). BE IT URDAIM,- BY Tn, COUIdCIL OF THE VILLkGE QF TdkYFIELD, 5TxTF OF OHTO: SECTION'L.1. That the Council i'inds and determines that the present valize of the said plant as a going concern as said plant existed on the lst day of Novembei°, 1925, and as shovm on the exnibits a-ttached to said letter of The Cleveland Eloctric Illuminatino Company, dated 1VOVember 7-th, 1925, is $10, 467. 49. SFCTION. 2. THAT the Village accept said ofter of The Cleveland Electric Illuminating CoripanJ and sell said plant for the surn of $10,467e49, and that the proper of"ficers of the Village be, and they are hereby authorized and directed upon the paym.ent of said sum of 610,467049, -IMUG ea:ecute and deliver to The Cleveland E1ec-tric Illuminating Company, its successors and assigns, a proper conveyance of said plant. 1?1
