ORDINANCE No,.151 <br />BY MR. VPILLIS. <br />A1V ORDINANCE PROVIDING FOR THI, EtvIPLOYNIENT OF <br />LEGAL COUiqSEL FOR THE VILLAGE OF MAYFTELD. <br />Y;CIiEREAS, the Council deems it for the best interest of the VilZage <br />to provide legal counseT for the same and for the officers thereofe <br />NOtiv, THEREFORE, BE..IT ORDgIVED by the Council of the Village of <br />flliayfield., Cuyahoga County, State of Ohio: <br />Section l. That the Zaw firm of Spring? Sayre and Vail be and it <br />is hereby emgloyed to :act as legal counseZ for said ViZlage and the officers <br />thereof in their official capacity, and as such to prosecute or.defend all <br />actions' by or against said Village, or any clepartment or officer thereof. <br />Section 2. That it shall prepare and submit to the Council all <br />reaolutions ar_d orc3.inances of whatsoever character or nature necessary, for <br />a11 public improvements and for the issuance of bonds and every purpose author- <br />ized by law, a.nd that it sha71 prepare a11 other resolutions and ordinances <br />as such are requested by this Council or any d.epartment of this Village. <br />Section 3. That it shall be appointed for a period of one (1) <br />year ending January lst, I935, and shall receive as compensa-tion the su.m of <br />Three Hundred and Sixty Dollars (t-360.00) per annum, gayable in equal month- <br />ly installments, which compensation shall cover aII generaZ services rendered <br />the said Village as such 1egal counsel' provid.ed, however, that said legal <br />counsel shaTl be paid additional compensation in the amount of One Hundred <br />Dollars for legal services rendered in connection with each improvement made <br />by the Village and the preparation of legislation in connection therewith, <br />vuhich additional compensation sha.Il, in the case of a special assessment im- <br />provem2nt, bE charged a.gainst the res.pective improvement and shall be included <br />as a part of the cost thereof, and provided, further that it sha1l receive <br />the sum of Twenty-five Dollars per diem for time spent in court, other than <br />in Mayor's Court, in the Iitigation of Village matters. The compensation here- <br />in provided fbr., e-zcegt that to be chargea against a special assessment im- <br />provement, sha.Il be payable out of the General Fund of said Village. <br />Section 4. That any necessary reasonable expenses incurred in <br />the performance of its. duties sha21, after being approved by this Cou.ncil <br />be authorized to be paid. Section 5. This Ordinance is hereby declared to be an Ernergency <br />Ordinance necessary for the immediate preservation of the public health and <br />safety for reasons apparent from the contents of this Ordinance. <br />Passed the 2nd day of January., A.
