In a dwelling or apartment occupied as aprivate residence, not <br />more than two rooms may be rented or table board furnished to not more than <br />four persons,provided no windo-w display or signboard is used to advertise such <br />use. In a US district a restaur,a.nt,or public dining room may be Ioeated in a <br />hotel or apartment house as an accessory uss. <br />Section 8. Commercial distriete (a) In a class U4 district no building <br />or premises shall be used, and no building sha1Z be erActed which is arranged, <br />intended or designed to be used; for.a class U5., II6_or U7 use. In a class U4 <br />district no building or premises shall be used, and.no building shalZ be erec-L-ed <br />which is arrang.ed, intended or designecl to be used; except for a class UI, U2, <br />U3 or II4 use. <br />(b) An accessory use customariTy ,i.ncident to a cla.ss U4 use shall also <br />be permitted in a cZa,ss II4 district provided such accessory use is located upon <br />the same lot -ui.th the builr7.ing or use .to which it is accessory::. A private <br />garage, permitttd as an accessory use shaLl not provide storage for more than <br />one motor vehicle for each 1,000 square feet of lot area. Provided that no <br />building or premises Sha.I1 be used, and no buiZdin.g shall be erected, which is <br />.arranged, intsnded or designed to be used, for a class U5 use unless upon a lot <br />approved after pubTic notice and hearing by the city planning and zoning commi.s- <br />sion as being a Iocation -where such use -wiLZ-in the judgment of the city planning <br />and zoning commission substantially serve the public convenience and welfare <br />and wiI1 n.ot substantially and permanently injure the appropria.te use of neighbor- <br />ing property. . <br />Section 9. Use district exceptions. (1) The city planning and zoning <br />eommission ma.y in specific cases, after pu.blic notice and hearing and subject? <br />to such conditions and safeguards as the commission may es-tablish, determine <br />and vary the application of the use district regulations herein established? <br />-which permission shall be confirmed by resolution of the council before <br />becoming effective, as folZows: <br />(a) Permit the exuension of a building or use into a more restricted <br />district immediately as3jacent thereto but not more than 50 feet beyond the <br />boundary Iine of the district in which such builaing or use is authorized. <br />(b) Permit the extension of a non-conforming use or building upon <br />the lot occupied by such use or builc7.ing at the time of the passage of this <br />ordinance. <br />(c) Permit in a use district any use deemed by the commission in general <br />keepi.ng -with the uses authorized in such dist-rict. <br />(d) Grant in undeveZoped sections of the vi.I:Cage temporary. anr1 con- <br />ditional permits for not more than two year periods for structures and uses <br />tha.t do not confbrm to the regulations herein prescribed for the use clistrict <br />in which they are to be Iocated. <br />- (.e)_ Permit the location of a cZass.U6 use in any use district provided <br />such use in such Zoca'uion -uill. in the jumgment of the city planning and zoning <br />commission substantia7ly Serve the public convenience and wel.fare and will not <br />snbstanti.aIly and permanently injure the appropria.te use of the neighboring <br />propertyo • <br />-6-
