EXCAVATION.
1563.01 General.
In addition to the requirements of Chapter
23, all excavations for dwellings and appur-
tenant structures and excavations accessory
thereto shall be protected and guarded
against danger to life and property.
1563.02 Protection of Property.
(a) Footings or foundations. No excava-
tion for any purpose shall extend within 1
foot of the angle of repose or natural slope
of the soil under any footing or foundation
unless such footing or foundation is first
properly underpinned .or protected against
settlement.
(b) Adjoining properties. The person
causing any excavation to be made shall
prevent the movement of the earth of ad-
joining properties and the trees and natural
objects thereon or therein, and shall be re-
sponsible for maintaining or restoring public
sidewalks, curbs, pavements and the prop-
erties of public utilities which may be af-
fected by the excavation,
(e) Restoration of public property. The
maintenance and restoration of public side-
walks, curbs, pavements and any other areas
within the dedicated highway shall be per-
formed in accordance with all ordinances,
and all rules and regulations of the building
department and other departments of this
Municipality having jurisdiction over same.
•
• ~
• i
59
CHAPTER 59. CHIMNEYS, FLUES AND GAS VENTS.
1559.01 Flue connecti®ns required.
(a} Heat appliances requiring chimneys
or Type A flues. Except for oil-fired heat ap-
pliances specifically approved by the.Board
of Building Code Appeals for use without
flue connections, all low temperature heat
appliances using liquid or solid fuel or which
can be converted to the use of liquid or solid
fuel, incinerators, and all gas-fired heat ap-
pliances, which produce flue gas tempera-
tures in excess of 550 F at the outlet of the
draft hood when burning gas at the manu-
facturer's input rating, shall be connected to
a chimney or an approved Type A flue. No
gas lags, gas grates, gas-fired radiant heaters
or similar heat appliances shall be installed-
exceptin afireplace connected with a chim-
ney or an approved Type A flue.
(b) Heat appliances permitting Type B
Gas Vents. Except as provided.in the para-
graph (c) of this section, gas-fired heat ap-
pliances which require flue connections and
produce flue gas temperatures not in excess
of 550 F at the outlet of the draft hood when
burning gas at the manufacturer's input rat-
ing, shall be connected to a chimney, an ap-
proved Type A flue or an approved Type B
gas vent. With the exception of incinerators
and conversion burners, all gas-fired heat
appliances listed by AGA as producing flue
gas temperatures not in excess of 550 F at the
outlet of the draft hood shall be deemed ap-
proved by the Board of Building Code Ap-
peals unless and until by formal action it
disapproves the same.
(c) Conditions permitting Type C' gas
vents. For runs from agar-fired heat appli-
ance directly from the space, iri which such
appliance is located, through a roof to the
outer air, Type C gas vents may be used
when installed in a manner approved by the
Building Official. Such gas vents shall not
pass through any attic or concealed space
nor through any combustible floor.
1559.02 Gas-fired heat appliances requiring
flues or gas vents. ,
All gas-fired heat appliances having flue
collars, gas-fired water, heaters; room or
space heaters, and furnaces, irrespective of
size or location, shall be connected to a chim-
ney, flue or gas vent conforming to the pro-
visions of this Dwelling House Code. All
other gas-fired heat appliances and devices
shall be connected to an approved flue or gas
vent, except that no flue or gas vent con-
nection will be required for the following
heat appliances: ;' ~ -;
i. Bunsen burners and domestic hot plates.
ii. Domestic gas ranges, domestic laundry
stoves and domestic clothes dryers, when
listed by AGA for such use and so labeled.
iii. Automatically controlled heat appli-
ances having an input rating less than 5,000
Btuh, provided they are equipped with an
automatic pilot or aflame-responsive fuel
shut-off device.
iv. Special heat appliances specifically ap-
proved for installation without flue or gas
vent connections by the Board of Building
Code Appeals.
1559.03 Draft hoods.
Except for incinerators, dual fuel oven-
type combination ranges and units designed
for power burners or for forced venting,
every flue-connected gas-fired heat appli-
ance, unless its connection serves the same
purpose, shall be equipped with a draft hood
which either (i) has been listed by AGA, or
(ii) complies with other nationally recog-
nized standards acceptable to the Board of
Building Code Appeals. The draft hood shall
be attached to the flue collar of the heat ap-
pliance or as near to the heat appliance as
conditions permit and in a.position for which
it is designed with reference to horizontal
and vertical planes. The draft hood shall be
located so that the relief opening is not ob-
structed by any part of the heat appliance or
adjacent construction.
1559.64 Dampers.
No manually-operated damper shall be or
remain installed in any flue or vent con-
nector from a gas-fired heat appliance
equipped with a draft hood.
1559.05 Interconnection of vents and flues.
(a) Prohibited interconnections.
