ORDINANCE No. 51-a. <br />By Mr. Strater <br />AN ORDINANCE TO REGULATE THE USE, STORAGE and TRANS- <br />PORTAT201`I OF EXPLCSIVES,FOR-BLASTING PURPOSES AND _ <br />PYROTECTINIC ,DISPIlAYS. <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF T~lAYE'IELD, CUYAHOGA <br />COUNTY OHIO, THAT :.. _ _. _ _ _ . _ . _ <br />Sec, 10 It shall be unlawful for any person, firm or corporation, <br />to blast ~t dynamite, gun powder, or any other explosive compound, <br />within -the Brits of the Village of Tbla.~field, Ohio, unless there first <br />shall have, been ..obtained a zrr~.~~en permit from the Chief of Police. Said <br />permit shall set forth the tune at. which and~the circumstances under . <br />which said blasting may 'be dor_e. ,The fee for such permit sha]1 be X10.00 <br />and said pei~nit sYial]:"be' for such period .as the Chief of Police may., <br />' designate, but not 'for over.sixty,days; the permit may be renewed, by <br />by the Chief of Police ~ for . an adcli:t~.o{~al period of s~Xty days without <br />payment of additional fee. <br />Sec. 2._ Before a permit to do~blastir~g shall be issued, the <br />applicant for such permit shall file a ~ ]a.ability .irssurance :policy in <br />the sum of X100, 000.00 f or..any orie 'individual, and X300., 000:00 for <br />any accident, covering bodily in~;ury; wrongful~'death and property <br />damage of any':nature caused by such bl..asting,. „ Such poLcy must be <br />approved by the Solicitor of the Village and the' `policy. or a copy <br />thereof shall be ,filed with the Chief of "Police. <br />,,__.... <br />Sec A =3:~4.The. Chief, of Fol~.ce.; shall supply an Inspector~jVho sha17. <br />supervise a~ dri]1ing,~ `cTiarging, aid.' shooting of :a~71..holes, who shall <br />not be required by the contractor to work less than 6 hours in any one <br />day. The contractor shall compensate the V11J.a.ge of N7ayfield at the <br />rate of ~2a25 per hour for each hour charged under this section. <br />Sec. 1~. Blastin.g operations shall not be conducted between the <br />' hours of severe o' clock. P.1~~.& seven o° clock A. M., nor at any time on <br />Sundays, except by special permission of the..Chief of Police. <br />Sec. 5. At least 2l~. hours in advance of blasting, the blaster <br />shall give smitten notice specifying the location and intended tune of <br />blasting to the appropriate representatives of the gas, electric, water, <br />fire alarm, telephone, telegraph, and steam utilities which operate <br />t~ithin the ,municipality. In an emergency the Chief of Police may <br />waive the time limit and allow verbal instead of written notice to be <br />.given. <br />Sec. 6. TnJhen blasting is done in Congested areas or in close <br />proximity of a structure, railway or highway, the blast shall. be covered <br />before firing, with a mat constructed so that it is capable of preventing <br />fragments from being throVm. <br />
