(b) GUAkhA:TEE FUP1D: n consideration. of the prices to be paid for the v~rorlc herein specified, the Contractor hereby guarantees that the workmanship and materials provided under these specifications are in eTre:c^y respect first-class and, that for a period of t:!~ree years, fron•~ and after acceptance of said work, the pavement shall require no repairs, the necessity for which shall be occasioned byT defects in vorkmanship or material. If, 'rAovrever, during sai d period of paving guarantee, the pavement shall require repairs or renewals, vrzi cr, repairs m~.y be occas~.oned by settlement of foundation, defective workmanship or materials used in construction then such r;pai rs vJill be begun by Contractor vrithin ten days after notice from t're Engineer. There v~~ill be retained by said munici pality, from the amount due upon the final estimate, a sum. of money, as a deferred payment, equal in amount to fifteen cents per square yard for all pavement, v,~hich amount grill. be retained by the municipality as a guarantee upon part of the Contractor that the v~orkmansl~ip and materials furnished under the specifications are in all respects first-class, as herein provided and the pa~d.ng v~rill remain in good and sound condition, for and during the period of paving g•~3arantee after completion of and acceptance of vrork by Engineer and Council . Should the Contractor ma'~e all necessary repairs, as directed, at expiration of guarantee, then said amount, less any expense that the municipality may have incurred, stall be returned to :said Contractor as full payment for any balance due on said contract and improvement as herein provided. SlZOUld snow, ice or mud prevent Contractor from making repairs at expiration of the time specified then this guarantee shall remain in fall foxce and effect until such time as it becomes possible to make inspection and repair.
