CONfiRACT <br />WITH THE BOALZD OF COUNTY COMISSIONERS OF CUYAHOGA <br />COUhTY FOR THE ZN[].'ROVEMENT OF WIZSON in`I L`LS ROAD <br />BETWEEN ZAiiDEt2 ROAD AND SOM CENTER ROAD <br />? BE IT ORDATiVED BY TAE COUPtCIL OF THE VIZT.AGE OF ASAYFIEZD, CUYAHOGA COUNTY <br />OH10, THAT; <br />Sec, 1. The rSayor and the Clerk of the Village of N'iayf ield, Ohio, are <br />hereby authorized and directed to execute on behalf of tlie Village an Agreement <br />in writing with the Board of County Commissioners of Cuyahoga County Ohio, in <br />the form submitted by said Bo,ard, a copy of which has been filed with Council, <br />which Agreement shall provide, among other things, that the Village shall <br />pay the cost of a11 water main and appurtenance a2terations up to a maximum <br />of $9,750.00, including the extension beyond the limits of the new pavemen.t <br />of all existing water service lines, curb cock boxes, ancl connections, but <br />exclusive of the adjusting of main line valve boxes to grade, in connection <br />with the improvement of GJilson Mi11s Road, a county road, betiaeen lander <br />Road and SOM Center Road,by grading, draining and paving, in accordance <br />with plans, specif ications and estimates prepared by the County Engineer. <br />Said Agreement further provides that the Village*'s payment of said sum <br />in the maximum amount of $9,750.00 sha11 be mads in iive equal consecutive <br />yearly installments, the f irst payment to be made on February 1, 1961, the <br />second pa,vment on February 1, 1962, the third payment on February 1, 1965, <br />the f ourth payment on February 1, 1964, and the f ifth payment on February 1, <br />1965. - <br />Sec, 2. This Ordinance is hereby declared i.o be an energency measure, <br />necessary for the immediate preservation of the public health and saf ety <br />by reason of the condition of said road between the points hereinabove <br />designated, in consequence-whereo£ great public inconvenience is being <br />su£f ered and public travel endangered and delayed, and for the reason <br />that it is necessary to proceed at once in order to complete the improve- <br />ment of said road during the coming year. <br />Sec. 3. The Clerk is hereby directed to furnish to the Board o£ <br />County Commissioners of Cuyahoga Counzy Ohio a certif ied copy of this <br />Ordinance immediately upon the talcing effect thereof. <br />Passed this 19th day of.
