Ordinance No. 770 <br />By Mr. Zorn <br />AiV ORDINANCE TO AMEND SECTIONS 4 AND 12 OF ORDINANCE <br />No. 634 PERTAINING TO REQI7IREMENTS AND FENCING.FOR <br />SWINA'fING POOZS .. _ ._ . - .. <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, COUNTY OF CUYAHOGA <br />STATE OF .. OHIO , xHAT.: .. _ .. , ., . _ _ -. _ _ , .. . <br />Sec. 1. Section 4 of Ordinance No. 634, entitled; "An Ordinance <br />Setting Up Certain Requirements for Swimming Pools, Providing Regulations <br />for the Use and Ownership of Such Appurtenances and Prescribing Penalties <br />for Violations", is hereby amended to read as follows: <br />"Sec, 4. Requirements for Swimming Pools. <br />No swimming pool or pool used for cleansing purposes shall be <br />used or maintained unless all of the requirements of this <br />ordinance are complied with. No swimming pool shall be <br />constructed within f fifteen (15) feet of the rear or side property <br />lines, unless the owner. of the abutting property consents in <br />writing to a lesser distance. No swimming pool shall be <br />constructed in a f ront yard. No swimming pool may .be constructed <br />in a side yard, except with the written consent of the owners of <br />all the abutting property. Nor shall it be constructed within <br />20 Eeet of a dwelling located on an abutting property, except <br />with a written consent of the owner of such abutting property." <br />SeC. 2. Section 12 of said Ordinance No. 634 is hereby amended to <br />read as follows; <br />'0~ec. 12, Fencing. <br />All swimming. pools shall be kept free from any nuisance of any <br />nature. The area shall be fenced in case of family swimming <br />pools by a fence 4 feet in height and in case of public and <br />club swimming pools by a fence or enclosure not less than 8 feet <br />high, and the entrance to the fenced or enclosed area shall be <br />through a gate of the self closing type, with an approved lock. <br />All such pools shall at all times be under the supervision of <br />an adult person. The fences shall be of the open or transparent <br />type and shall be approved by the Building Inspector as to safety <br />hnd design, but a fence need not be of the Qpen or transparent <br />type nor be required to have a gate of the self closing type, <br />with an approved lock, if the only means of entrance and access <br />is to or from the dwelling house, but such fence must be in <br />conformity with the architectural design of the house. " <br />
