<br />AN ORDINANCE AUTHORIZING THE CONSTRUCTION OF A WATER
<br />MAIN IN BEECH HILL ROAD
<br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, CUYAHOGA COUNTY,
<br />OHIO, THAT:...• - . - .. •.
<br />Sec, l,-Council hereby authorizes Leslie Belzer to have constructed
<br />an 8 inch water main with appurtenances in Beech Hill Road in the Village of
<br />Mayfield, starting at the corner of Beech Hill Road and Seneca Road, and
<br />extending Northerly at about 235 lineal f sets Said water main is to be
<br />constructed for said Leslie Belzer by The Northern Ohio Paving Co. according
<br />to the rules and regulations-of the water department of the City of Cleveland,
<br />Ohio, in accordance with the plans, prof ices and specifications approved by
<br />H. P. Peterson, the Village Engineer, and subject to the approval of the
<br />Building Inspector of ,the Village of Mayfield, or any Inspector especially
<br />appointed.f or that purpose by the Gouncil, The construction of said water
<br />main and appurtenances is to be done in accordance with the terms of the
<br />contract between Leslie Belzer and Northern Ohio Paving Co. In connection
<br />with said contract, there is to be deposited with the Village,of Niayf field
<br />a policy ( or a copy or certificate thereof) of liability insurance, insuring
<br />against bodily injury liability in the amoutlt of One Hundred Thousand Dollars
<br />($100'000,00) for each person and Three Hundred Thousand Dollars ($300,000.00)
<br />for each accident, and property damage liability.in the amount of Fifty Thousand
<br />Dollars ($50,000„00) in connection with the work to be done under said construction
<br />contract,. The said-contract shall also be accompanied by a cash performance
<br />bond or surety performance bond in the amount of Two Thousand Three Hundred
<br />Fifty .Dollars ($2350,00), inform to be approved by the Village Solicitor,
<br />guaranteeing performance of said contract and payment of all claims f orsmaterial
<br />and labor furnished in connection therewith. In the event that The Northern
<br />Ohio Paving Co, does not complete performance of the contract, the said Leslie
<br />Belzer shall complete the same, and if both fail to complete the performance
<br />of the contract, the Village of Mayf field shall have the right to complete
<br />construction and to look to Leslie.Belzer, The Northern Ohio Paving Co, and
<br />the company executing the surety bond for reimbursement therefor,
<br />Sec, 2a $aid construction work shall be supervised by H. Pm Peterson
<br />Company, Said Leslie Belzer shall pay all engineering costs in connection
<br />with the installation of said water main,
<br />See. 3® N0 person, firm, or corporation shall be issued a permit or
<br />be permitted to make a water connection to the above described water main within
<br />ten years after the date of this ordinance, unless such person, film or corporation
<br />making such connection first pays to Leslie Belzer, or his heirs, administrators,
<br />executors, successors or assigns, such ratio-of the cost of construction of said
<br />main ( as certif led by the Village Engineer) as the number of linear feet of
<br />water, main abutting such person, f inn or corporation~'~s property bears to the
