Belzer AN ORDINANCE TO AMEND ORDINANCE No, 159, THE ZONING ORDINANCE OF THE VILLAGE.OF HAYFIELD, BY ADDING SECTION 19,,1 PERTAINING TO_FENCES IN RESIDENTIAL DISTRICTS Tr7HERE.AS, adequate provisions are not made in the present zoning ordinance to govern the height and type of fences in residential districts, and it is necessary to do so in order that owners of property in such districts will not be deprived of necessary light and air and in order that their property will not be depreciated in. value by reason of the presence of unsightly and unsafe fences on adjacent property; and WHEREAS, Council finds that this amending ordinance has been sub- mitted to. the Village Planning and Zoning Commission for approval, disapproval, or suggestions, and that said Commission has allowed a reasonable time for consideration and reports and has approved the same in the form herein set forth, and that a public hearing has been had thereon, and notice of such hearing given in the manner provided by law.. NOW THEREFORE BE TT ORDAINED BY THE COUNCIL OF THE VIZLAGE OF HAYFIELD, COUNTY OF CUYAHOGA AND_STATE OF_OHIO, THAT:_ Sec. 1. ORdinance No, 159, the Zoning Ordinance of the Village of Hayfields is hereby amended by adding thereto Section 19.1,. which shall read as sollows: "Sec. 19,1. Fences in Residential Districts. (a) In Front Yards, In front yards in Class U~-1, U-2, U-3, and U-3 AA. Use Districts, the only fences permitted shall be open ornamental fences, which shall be placed adjacent to the front entrance of the dwelling, and not over 42 inches in height. An ornamental split rail fence may be placed at a point not closer than 12 inches f"rom the front property line, (b) In Side and Rear Yards. In side yards and rear yards in Class U-Z, U-~2, U-3 and U-3 AA use districts, the only fences permitted shall be as follows: Open fences not over 4-1f2 feet in height shall be permitted along the side line of rear yards and along the rear lot line, provided such fences shall have uniformly spaced openings aggregating 25% of their surface areas between residential propertiesq Provided, however, that an open or a closed fence not over eight feet in_height may be placed along the rear or side line which separates residential property from property used for non-residential purposes, subject to the written approval . of the adjacent property owner and the approval of the Building Inspector, who shall not give his approval if he finds that such proposed fence is unsafe or unsightly or that it obstructs necessary light and air from adjacent
