Mason <br />AN ENIERG~ICY ORDINANCE AUTHORIZING AN AGREEMENT WITH <br />THE VILLAGE OF WILLOUGHBY-HILLS-FOR THE CONSTRUCTION <br />,AND MAINTENANCE OF_A,WATER.MAIN WITH.AFPURTENANCES <br />IN .WHITE .ROAD _ ..... <br />WHEREAS, Section 715.02 of the Revised Code of Ohio authorizes and <br />empowers the Village of Mayf field and the Village of Willoughby Hills to <br />enter into an agreement for the construction and management of the herein- <br />af ter described public improvement; and <br />WHEREAS, this Council finds that the construction and maintenance of <br />a water .main in White Road will benefit the Village of Iviayfield and the <br />abutting property owners along said T,Tktite Road and the other inhabitants <br />of the Village; and <br />WHEREAS, Willoughby Hills has proposed to this Council that it proceed <br />with the installation of such water main witiz appurtenances and this Council <br />is desirous of entering into an agreement governing the installation of such <br />water main, the method of payment of the cost thereof, and the control and <br />management of such water main. <br />NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, <br />STATE OF OHIO: _ ._ <br />Sec. 1. That the Village of Mayf ielci shall enter into an agreement with <br />the Village of ~Jilloughby Hills, which provides for the joint design, financing, <br />construction, operation, control and management of a water main with appur- <br />tenances to be installed in White Road from its intersection with SCAM Center <br />Road westerly approximately 2,000 feet to the easterly right-of-way line of <br />State Route 1. The form of such agreement shall be approved by the Solicitor <br />and ref erred back to Council for approval. <br />Sec. 2. This ordinance is hereby declared to be an emergency measure, <br />necessary for the immediate preservation of the public peace, safety, health <br />and welfare of the inhabitants of the Village of Mayf field, the reason of <br />such necessity being the urgent need for a supply of water to residents of <br />White Road and the urgency for a water supply to such inhabitants and their <br />homes in case of fire emergencies; for which reasons an emergency does exist; <br />provided it receives the two-thirds vote of all members of the Council elected <br />thereto, this ordinance shall be in full force and effect immediately after the <br />earliest period allowed by law. <br />Passed this 20th day of May, 1963. <br />Attest: <br />c ~~ ..- ~~ <br />(S~ L) / Clerk <br />Nlayor - resi nt of Counci <br />
