ORDINANCE No. 818 By Mr. Belzer AN ORDINANCE DETERivIINING TO PROCEED WITH THE IMPROVEMENT OF LANDER ROAD IN TFiE.VILI,AGE OF HAYFIELD BY CONSTRUCTING .. - A_SANITARY SEC+FER WITH CURB CONNECTIONS THEREFOR AND THE NECESSARY APPURTENANCES AND DECLARING AN_ENIERGENCY_ BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, CUYAHOGA COUNTY, OHIO, THAT;. _ .. - - .. _ - . _ ~ - - Sec. 1, It is hereby determined to proceed with the improvement in the Village of Mayfield, Ohio, of Lander Road from the existing sanitary sewer in Wilson dills Road Southerly to the Southerly corporate line of the Villages of Mayfield and Highland Heights. _ Sec. 2. Said improvements shall be made in accordance with the provisions of Resolution No. 566 adopted July 15, 1963, and with the plans, specif ications, estimates, and profiles heretof ore approved and now on file in the off ice of the Clerk of this Council by constructing a sanitary sewer with curb connections therefor and the necessary appurtenances. Sec. 3. All claims for damages resulting therefrom that have been legally filed shall bd enquired into before the commencement of the propesed improvement and the Solicitor is hereby authorized and directed to institute legal proceedings in a court of competent jurisdiction to enquire into any claims that have been so filed. Sec. 4. That portion of the cost provided in the above mentioned resolution of necessity to be assessed shall be assessed in the manner provided in said resolution on the lots and lands described therein, but in twenty (20) annual installments, otherwise in all respects as set forth in said resolution. Sec. 5. The estimated assessments heretof ore prepared and filed in the off ice of the Clerk of this Council and approved by the Assessment Equalization Board are hereby adopted. Sec. 6. The Clerk of this Council is hereby directed to deliver a certif ied copy of this ordinance to the County Auditor within fifteen days of ter its passage. _ Sec. 7. Subject to the provisions of Section 727,24 of the Ohio Revised Code, the Mayor and the Clerk of the Village are hereby authorized and directed as soon as the funds therefore are available to malce and execute a contract for said improvement for the lowest and best bidder after advertising according to law and the improvements shall be financed as provided in :the resolution of necessity as herein mod if ied as to the number of installments of annual assessments.
