ORDINANCE No. 818 <br />By Mr. Belzer <br />AN ORDINANCE DETERivIINING TO PROCEED WITH THE IMPROVEMENT <br />OF LANDER ROAD IN TFiE.VILI,AGE OF HAYFIELD BY CONSTRUCTING <br />.. - <br />A_SANITARY SEC+FER WITH CURB CONNECTIONS THEREFOR AND THE <br />NECESSARY APPURTENANCES AND DECLARING AN_ENIERGENCY_ <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, CUYAHOGA COUNTY, <br />OHIO, THAT;. _ .. - - .. _ - . _ ~ - - <br />Sec. 1, It is hereby determined to proceed with the improvement <br />in the Village of Mayfield, Ohio, of Lander Road from the existing sanitary <br />sewer in Wilson dills Road Southerly to the Southerly corporate line of the <br />Villages of Mayfield and Highland Heights. _ <br />Sec. 2. Said improvements shall be made in accordance with the <br />provisions of Resolution No. 566 adopted July 15, 1963, and with the plans, <br />specif ications, estimates, and profiles heretof ore approved and now on file <br />in the off ice of the Clerk of this Council by constructing a sanitary sewer <br />with curb connections therefor and the necessary appurtenances. <br />Sec. 3. All claims for damages resulting therefrom that have been <br />legally filed shall bd enquired into before the commencement of the propesed <br />improvement and the Solicitor is hereby authorized and directed to institute <br />legal proceedings in a court of competent jurisdiction to enquire into any <br />claims that have been so filed. <br />Sec. 4. That portion of the cost provided in the above mentioned <br />resolution of necessity to be assessed shall be assessed in the manner provided <br />in said resolution on the lots and lands described therein, but in twenty (20) <br />annual installments, otherwise in all respects as set forth in said resolution. <br />Sec. 5. The estimated assessments heretof ore prepared and filed in <br />the off ice of the Clerk of this Council and approved by the Assessment <br />Equalization Board are hereby adopted. <br />Sec. 6. The Clerk of this Council is hereby directed to deliver a <br />certif ied copy of this ordinance to the County Auditor within fifteen days <br />of ter its passage. _ <br />Sec. 7. Subject to the provisions of Section 727,24 of the Ohio <br />Revised Code, the Mayor and the Clerk of the Village are hereby authorized <br />and directed as soon as the funds therefore are available to malce and <br />execute a contract for said improvement for the lowest and best bidder <br />after advertising according to law and the improvements shall be financed <br />as provided in :the resolution of necessity as herein mod if ied as to the <br />number of installments of annual assessments. <br />
