ORDINANCE No. 820 <br />By Mr. Shaw <br />AN ORDINANCE PERTAINING TO THE PRIVATE USE OF FIRE <br />HYDRANTS AND REPEALING ORDINANCE N0. 506. _, <br />BE IT ORDAINED BY THE COUNCIL, OF THE VILZAGE OF HAYFIELD, CUYAHOGA COUNTY, <br />OHIO, THAT: . <br />Sec. 1. It shall be unlawful for any person, firm, or corporation <br />( other than the,Fire Department, or any other official or department of the <br />Village of Mayfield in,its official capacity ) to tap or connect into, or use <br />any water from any fire hydrant within the Village of Mayfield, Ohio, whether <br />on or along dedicated or undedicated streets or on private property, except <br />in the following instances: <br />(a) For the extinguishment of fires or other emergency use, under <br />the direction of the Fire Department; <br />(b) For use in tn.e construction of new buildings or improvements <br />upon permit obtained from the City of Cleveland Water Department <br />and from the Building Inspector & Service Director'of the <br />Village of Mayfield , who shal l charge a f ee of $1.00 for each <br />such permit, and may require a cash deposit or other security <br />to secure the Village against any damage caused by the permit <br />holder to hydrants or other property of the Village. <br />Sec. 2. Whoever shall violate Section 1 of this ordinance shall be <br />guilty of a misdemeanor, and upon being found guilty thereof, shall be punished <br />by a f ine of not more than $500.00, or be imprisoned for not more than 30 <br />days, or both, and shall stand committed until such fine is paid. <br />Sec. 3. Ordinance No. 506, entitled: "An Ordinance Prohibiting the <br />Private Use of Fire Hydrants for Purposes Other than Extinguishment of Fires", <br />is hereby repealed as of the effective date of this Ordinance. <br />Sec. 4. This Ordinance is hereby declared to be an emergency measure, <br />necessary for the immediate preservation of the public peace, health, saf ety <br />and welf are of the Village of Mayf field and its inhabitants, in order to insure <br />that fire hydrants will be available for fire fighting and other emergency <br />purposes at all times, and this ordinance shall take effect and be in force <br />from and of ter the date of its passage. <br />Passed this day of 1963. <br />-- <br />Attest: v L ~ <br />Mayor - President of Council <br />S ~ AL ) ~C~.e'rk <br />~` <br />
