ORDINANCE No. 835 By Mr. Sha~ AN ORDINANCE PROVIDING FOR THE EI~11'LOYMENT OF LEGAL COUNSEL FOR,THE VILLAGE OF i~AYFI~,LD_ WHEREAS, Council deems it for the best interests of the .Village to provide legal counsel for the same and for the officers thereof. NOW THEREFORE BE IT ORDAINED BY THE COUNCIZ OF THE VILLAGE OF HAYFIELD, CUYAHOGA COUNTY OHIO THAT:. ~ . . Sec. 1. Arnold M. Edelman, Attorney at Law, be, and he hereby is, employed to act as legal counsel for said Village and the officers thereof in their off icial capacity, and as such to prosecute and defend all legal actions by or against said Village, or any department or officer thereof to which he may be assigned by Council or by the Mayor. Sec. 2. He shall prepare and submit to Council all resolutions and ordinances of whatsoever character or nature necessary f or all public improvements and for the issuance of bonds and every purpose authorized by law, and he shall prepare all other resolutions and ordinances as are requested by this Council or any department of this Village. Sec. 4. He shall be appointed for a period of two years, from January 1st, 1964, to December 31st, 1965, both days inclusive, and shall receive as compensation the sum of $3,000.00 per annum, payable in equal monthly installments, which compensation shall cover all general services rendered to the said Village as such legal counsel, with the exception of the following: (a) Such legal counsel shall be paid the additional sum at the rate of $150.00 per diem for time spent on behalf of said Village or any department or officer thereof in any trial or proceeding before any court ( other than the Mayor's court of the Village of Mayfield) or before any other public board or commission ( other than a board or commission of this Village) and at the rate of $20.00 per hour for time spent in preparation,f or any such trial or proceeding; (b) Such legal counsel shall be paid the additional sum of $250.00 for legal services rendered in connection with each general obligation bond issue of said Village. For each improvement to be financed by special assessments, such legal counsel shall be paid an amount equal to 1-1/2% of the amount of the accepted bid, half at the time of the issuance of the special assessment note and half at the time of sale of the bonds, which shall be compensation for all legal services rendered in connection with the special assessment note and bonds issued in connection with such improvement, including the preparation of necessary legislation and the super- vision of the preparation of transcripts of the proceedings in connection therewith; provided, however that compensation for
