ORDINANCE No. 854 <br />By Mr. Shaw <br />AN ORDINANCE AUTHORIZING THE MAYOR TO PROCLAIM A WATER <br />SHORTAGE AND RESTRICTING THE WATERING OF LAWNS, SHRUBS, <br />TREES Ai~TD Gt~.RDEDJS , .AND PROVIDING A -PENALTY FOR VIOLATION <br />THEREOF. ~ , . .. .. . <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF NIAYFIELD, CUYAHOGA COUNTY <br />OHIO, THAT: -- - - ~ - <br />Sec. 1. W1i.enever the Mayor of the Village of Mayfield, Ohio, determines <br />that a water shortage exists to such an extent as to impair fire protection <br />and the public health within the Village of Mayfield, he may issue a <br />proclamation, which shall be posted in the same manner as Ordinances, <br />declaring that a water shortage exists and restricting the use of water <br />furnished by the City of Cleveland for watering any lawn, shrubs, trees or <br />gardens in specif ied sections of the city and during specified hours. <br />During the existence of any water shortage so determined and proclaimed, no <br />person shall use or allow to be used on any premises in this city under his. <br />charge or control any water furnished by the City of Cleveland for watering <br />any lawt},shrubs, trees or gardens at any time such use is restricted. <br />Sec. 2. Whoever shall violate the terms of this ordinance shall be <br />fined in an amount not exceeding $25,00 f or'each violation, Any member of <br />the Police Department of the Village of Mayfield may go upon premises to <br />shut off the supply of water which is being used in violation of the terms <br />of this ordinance. <br />Sec. 3. This Resolution is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, health, <br />safety and welfare, because the use of water in violation of this ordinance <br />during a period of drouth can endanger the public health and fire protection, <br />and this ordinance shall be in force and effect from and of ter the date of <br />its passage., <br />Passed this 13th day of July, 1964. <br />..~- <br />Attest: - Mayor - res dent of Counci <br />S AL) __ lark <br />
