RESOLUTION N0. 86- 26 <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />A RESOLUTION ACCEPTING THE FINAL PLAT <br />I'OR HP,NOV ER WOODS SUBDIV IS ION N0. 2 AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the final plat for Hanover Woods Subdivision No. 2 <br />has been submitted to the Village for approval; and <br />WHEREAS, the said final subdivision plat, has been approved <br />by the Planning & Zoning Commission and by the Village Engineer, the <br />approval of the latter being included in a letter dated May 16, 1986, <br />a copy of which is attached hereto, marked Exhibit "A" and <br />incorporated herein as if fully rewritten; and <br />WHEREAS, the Mayor and Council of the municipality have <br />determined that the subdivision complies with all other applicable <br />provisions of the Codified Ordinances of Mayfield Village, Ohio, <br />pertaining to planning, platting and subdividing procedures; now, <br />theref ore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The Council of Mayfield Village, Ohio, hereby <br />approves the final plat of Hanover Woods Subdivision IVo. 2 for <br />recordation purposes only in accordance with the approval of the <br />Village Engineer dated May 16, 1986, a copy of which approval is <br />attached hereto, marked Exhibit "A" and incorporated herein as if <br />fully rewritten. Section 2. The Council finds that the loan commitment <br />procured by the developer in an amount equal to one hundred percent <br />(100%) of the estimate of the cost of the required subdivision <br />improvements, a copy of which is attached heretoo marked Exhibit "B" <br />and incorporated herein as if fully rewritten, constitutes sufficient <br />security for the construction of the said improvements pursuant to <br />Section 1115.06 (a) of the Codified Ordinances of Mayfield Village, <br />Ohio. <br />Section 3. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 4. This Resolution is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />health, safety and welfare of the residents of Niayfield Village for <br />the reason the approval herein is necessary in order to commence with <br />the construction of the reguired improvements for the said residential <br />subdivision. It shall therefore take effect immediately upon passage <br />by the affirmative vote of not less than four (4) members elected to
