RESOLUTION N0. 86- 28 <br />INTRODUCED BYe Mayor Carmen & Council as a Whole <br />A RESOLUTION ACCEPTING FROM HANOV ER <br />WOODS LIMITED PARTNERSHIP AN EASEMENT <br />FOR THE INSTALLATION AND MP,INTENANCE OF <br />A WATER MAIN FOR THE PURPOSE OF <br />SUPPLYING WATER SERVICE T0 THE HANOVER <br />WOODS RESIDENTIAL SUBDIVISION LOCATED IN <br />MAYFIELD VILLAGE, OHIO, AND DECLARING AN <br />EMERGENCYo <br />WHEREAS, Hanover Woods Limited Partnership has granted to <br />the municipality an easement for the installation and maintenance of a <br />water main for the purpose of supplying water service to the Hanover <br />In7oods Residential Subdivision located in Mayfielc] Village, Ohio; and <br />WHEREAS, the afaresaid easement provides, in part, that <br />Hanover Woods Limited Partnership shall bear the total cost for the <br />installation of the aforesaid water main; and <br />WHEREAS, the Mayor and Council have determined that it is in <br />the best interests of th_e orderly development of the municipality to <br />accept the easement as granted by Hanover Woods Limited Partnership; <br />now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, TI3ATe <br />Section l. The Council of Mayfield Village, Ohio, does <br />hereby accept the grant of easement from Hanover Woods Limited <br />Partnership for the installation and maintenance of a water main for <br />the purpose of supplying water service to the Hanover Woods <br />Residential Subdivision lacated within the municipality. The easement <br />accepted herein shall be in a form approved by the Director of Law and <br />be substantially similar to the one attached hereto, marked Exhibit <br />"P,°" and incorporated herein as if fully rewritten. <br />Section 2. The Mayor and Director of Finance are hereby <br />authorized and directed to execute whatever documents are necessary in <br />order to effect the acceptance of the easement authorized herein. <br />Section 3. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121022 of the Ohio Revised Code.
