RESOLUTION N0. 86- 31 <br />Page -4- a manner as to constitute a nuisance, or permitting the <br />grounds or buildings to become unsafe or unsightly; <br />(4) Abandonment of the use of the premises as an <br />auto body repair shop or towing service for automobiles <br />for a continuing period of one (1) year or longer. <br />M. The Permit granted herein shall be effective only so <br />long as the Permittee remains an occupant of the subject <br />premises. <br />N. The Permittee must maintain a current log detailing the <br />date on which each automobile is brought on to the premises and <br />the date on which each automobile is removed from the premises, <br />and which log shall be made available to the municipality at <br />reasonable times and locations to a member of the Building <br />Department designated by the Mayor. <br />Section 4. The Permittee shall have no more than ninety <br />(90) days to comply with any violation of the terms and conditions set <br />forth hereinabove, said ninety (90) day period to commence after the <br />Permittee receives written notice from the municipality of such <br />violation. <br />Section 5. The Special Use Permit granted herein shall be <br />in force and effect for a period of three (3) years following the <br />effective date of this Resolution. <br />Section 6. Any ordinance or resolution in conflict with <br />this resolution in whole or in part is hereby repealed to the extent <br />necessary to avoid conflict with this resolution. <br />Section 7. That the Council finds and determines that all <br />f ormal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />f ormal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121a22 of the Ohio Revised Code. <br />Section 8. This Resolution is hereby declared to be an <br />emergency measure ianmediately necessary for the preservation of the <br />healtha safety and welfare of the residents of Mayfield Village in <br />that it will help insure the nuisance free operation of a commercial <br />enterprise in a residential neighborhood thereby protecting the values <br />of the neighboring property. It shall therefore take effect immedi° <br />ately upon passage 6y the affirmative vote of not less than four (4)
