RESOLUTION N0. 86-35 <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />A RESOLUTION VACATING A STORM SEWER EASEMENT ON <br />SUBLOTS 97 AND 98 IN AINTREE NORTH SUBDIVISION N0. <br />2 AND DECLARING AN EMERGENCY. <br />WHEREAS, the municipality has previously been granted a <br />storm sewer easement by the Aintree North Development Company on <br />Sublots 97 and 98 in the Aintree North Subdivision No. 2; and <br />WHEREAS, the Aintree North Development Company and Mayfield <br />Village are desirous of abandoning and releasing the aforesaid storm <br />sewer easement; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. Mayfield Village does hereby abandon and <br />release the storm sewer easement previously granted to it on Sublots <br />97 and 98 in the Aintree North Subdivision No. 2 by the Aintree North <br />Development Company. <br />Section 2. The Clerk of Council is hereby authorized and <br />directed to endorse the abandonment and release of the aforesaid ease- <br />ment on a document entitled "Release of Easement", a copy of which is <br />attached hereto and marked Exhibit "A". <br />Section 3. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 4. This Resolution is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />health, safety and welfare of the residents of Mayfield village for <br />the reason that the abandonment of the easement as authorized herein <br />is necessary to maintain steady development of Aintree North <br />Subdivision No. 2. It shall therefore take effect immediately upon <br />passage by the affirmative vote of not less than four (4) members <br />elected to Council and approval by the Mayor or otherwise at the
