RESOLIITION N0. : 86- 43 <br />INTRODUCED BYe Mayor Carmen & Council as a Whole <br />A RESOLUTION DECLARIrIG HORVITZ PAVING TO BE THE <br />LOW EST AND B EST BIDDER FOR THE RESURFACING OF <br />CERTAIDI ROADS WITHIN THE MUNICIPALITY, AUTHORIZING <br />THE MAYOR AND DIRECTOR OF FINANCE TO EXECUTE A <br />CONTRACT WITH HORVITZ PP,VING IN AN ANiOUNT NOT TO <br />EXCEED NINETY FIV E THOUSAND NINE HUNDRED EIGHTY <br />DOLLARS ($95,980.00)` REJ ECTING ALL OTHER BIDS <br />RECEIVED AND DECLARING AN EMERGENCY. <br />WHEREAS, the Mayor and Council of Mayfield Village, Ohio, <br />have previously determined that Worton Park Drive, Seneca Road, and <br />the asphalt portion of Thornapple Drive are to be resurfaced during <br />calendar year 1986; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section lm In accordance with bids received pursuant to <br />advertisement as required by law, Horvitz Paving is hereby declared to <br />be the lowest and best biclder for the resurfacing of Worton Park <br />Drive, Seneca Road, and the asphalt portion of Thornapple Drive, all <br />located within Mayfield Village, Ohio. <br />Section 2s The Mayor and Director of Finance are hereby <br />authorized and directed to execute a contract with Horvitz Paving in <br />an amount not to exceed Ninety Five Thousand Nine Hundred Eighty <br />Dollars ($95,980.00) for the aforesaid project provided that said <br />contract is in accordance with the specifications upon which the bid <br />was received. <br />Section 3. All other bids received are hereby rejected. <br />Section 4. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />f ormal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 5. This Resolution is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />health, safety and welfare of the residents of Mayfield Village for <br />the reason that the contract awarded herein is necessary to maintain <br />an effective street repair program within the municipality.
