*NOTE: NO FINAL ACTION TAKEN. <br />RESOLUTION N0. 86- 51 <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />A RESOLUTION AUTHORIZING THE MAYOR AND DIRECTOR OF <br />FINANCE TO ENTER INTO A CONTRACT WITH COOK PAVING <br />AND CONSTRUCTION CO., INC. IN AN AMOUNT NOT TO <br />EXCEED THIRTY TWO THOUSAND FIVE HUNDRED NINETY <br />FOUR DOLLARS ($32,594.00) FOR IMPROVEMENTS TO THE <br />VILLAGE SENIOR CENTER PARKING LOT, THE AWARD OF <br />SAID CONTRACT TO BE CONTINGENT UPON ACCEPTP,NCE OF <br />SAME BY THE BOARD OF COMMISSIONERS OF CUYP,HOGA <br />COUNTY AND DECLARING AN EMERGENCY. <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1, In accordance with bids received pursuant to <br />advertisement as required by law, Cook Paving and Construction Co., <br />Inc, is hereby declared to be the lowest and best bidder for improve- <br />ments to the Village Senior Center parking lot. <br />Section 2. Subject to the contingency hereinafter set <br />forth, the Mayor and Director of Finance are hereby authorized and <br />directed to enter into a contract with Cook Paving and Construction <br />Coo, Inc, in an amount not to exceed Thirty Two Thousand Five Hundred <br />Ninety Four pollars ($32,594.00) for the construction of the aforesaid <br />improvement provided that the contract is in accordance with the <br />specifications upon which the bid was received. <br />Section 3. The contract authorized herein is specifically <br />contingent upon the acceptance of same by the Board of Commissioners <br />of Cuyahoga County, Ohio. <br />Section 4. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, res.ulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 5. This Resolution is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />health, safety and welfare of the residents of Mayfield Village for <br />the reason that the contract authorized herein is necessary to <br />commence necessary improvements to the Senior Center parking lot. It <br />shall therefore take effect immediately upon passage by the affirma- <br />tive vote of not less than four (4) members elected to Council and <br />approval by the Mayor or otherwise at the earliest time allowed by
