IV. PRDVISIONS OONCE[7NING CE37,TAIN WAIVERS <br />Subject to applicable law, any right or remedy which the <br />COUNTY may have tmder this Contract may be waived in writing by the 0(xlNR'Y <br />if, in the judgement of the OOUNTy, this Contract, as modified, will etill <br />conform to the terms and requirementa of the pertinent laws. <br />V. WM RICHTS AND RIIMEDIffi NOrf WAIVED . <br />In no event shall the making by the COUNTY of any'payment to <br />the OOhiMUNITY constitute or be construed as a waiver by the COiINTY of aqy <br />breach of covenant or any default which may exist on the part of the <br />OOPAIUNITY, and the making of any such payment by the QOiJN'I'Y, while any auch <br />breach or default exists, shall in no way impair or prejudice any right or <br />remedy available to the COUNTY in respect to such breach or default. <br />VI. COUNTY N(yf OBLIGATED TO THIRD PARTIES <br />The COUNTY shall not be obligated or liable hereimder to any <br />party other than the cONPiUNITY. <br />VII. MODIFICATION <br />By the mutual written consent of the COUNTY and the <br />OOhAfUNITY, this Contract mfsy be modified whenever such modifications are <br />deemed necessary. Ar?y such modifications to this Contract shall be reduced <br />to writing and signed by both parties. <br />VIII. SXTENT OF AG2ffiMMT <br />This Contract represents the entire and integrated agreement <br />between the COUNTY and the DONIINUNITY and supercedea all prior negotiations, <br />representations or contracts, either written or oral.
