RESOLUTION N0. 86-59 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />A RESOLUTION REQUESTING THE CUYAHOGA COUNTY <br />AUDITOR TO ADV ANCE TAXES FROM THE PROCEEDS <br />OF TAX LEVIES AND DECLARING AN EMERGENCY. <br />WHEREAS, Section 321.34 of the Ohio Revised Code provides <br />that money in a County Treasury to the account of a local authority <br />and lawfully applicable to the purpose of the current fiscal year, may <br />be withdrawn by a municipality upon proper request; and <br />WHEREAS, the Council has found and determined that sound <br />fiscal policy requires that such withdrawal be requested from the <br />Cuyahoga County Auditor; nowP therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. That the Cuyahoga County Auditor be and is <br />hereby requested to draw warrants and the Treasurer of Cuyahoga County <br />be and is hereby requested to pay the Village of Mayfield all monies <br />presently being held in the Cuyahoga County Treasury to the account of <br />the Village of Mayfield, lawfully applicable to the purpose of the <br />present fiscal year. <br />Section 2. That the Clerk be and is hereby authorized and <br />directed immediately to forward a copy of this Resolution to the <br />Cuyahoga County Auditor and the Cuyahoga County Treasurer. <br />Section 3. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements, including the requirements <br />of Section 121.22 of the Ohio Revised Codea <br />Section 4. This Resolution is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />health, safety and welfare of the residents of Niayfield Vilalge in <br />that the monies requested herein are necessary to maintain essential <br />governmental services.
