RESOLUTION N0. 85- 11 <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />A RESOLUTION OPPOSING THE ENACTMENT <br />OF H.B. 101, CURRENTLY PENDING <br />BEFORE THE GENERAL ASSEMBLY OF THE <br />STATE OF OH I0, WHICH WOULD PROHIBIT <br />EMPLOYERS FROM CONDUCTING POLYGRAPH <br />OR OTHER LIE DETECTOR TESTS UPON <br />PROSPECTIVE EMPLOYEES AS A PRE- <br />CONDITION FOR EMPLOYMENT UNLESS <br />SUCH LEGISLATION IS AMENDED TO <br />EXCLUDE PUBLIC EMPLOYERS. <br />WHEREAS, there is currently pending before the General <br />Assembly of the State of Ohio H.B. 101 which would prohibit employers <br />from requiring prospective employees to submit to polygraph, voice <br />stress analyzer or similar lie detector tests as a condition of <br />employment; and <br />WHEREAS, H.B. 101, under current law, would include public <br />employers within the scope of the said legislation; and <br />WHEREAS, the use of polygraph tests has been an invaluable <br />tool in assisting the safety forces of public employers by helping to <br />insure that prospective employees are truly qualified for these <br />demanding and sensitive positions; and <br />WHEREAS, the Mayor and Council of Mayfield Village, Ohio, <br />have determined that public employers should be exempted from the <br />provisions of H.B. 101; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The Mayor and Council of Mayfield Village, <br />Ohio, urge the General Assembly of the State of Ohio to defeat H.B. <br />101 as it is currently constituted or to amend said legislation before <br />enactment such that public employers are exempt from the prohibitions <br />of the legislation. <br />Section 2. The Clerk of Council is hereby authorized and <br />directed to forward a copy of this Resolution to Governor Richard F. <br />Celeste, and to the Cuyahoga County delegation to the General Assembly <br />and in so doing to request from each such person a written response to <br />the content of this Resolution. <br />Section _3.
